A parody site put up by the Simon campaign called www.E-Gray.com is getting both plenty of attention and laughs around the state and nation. Not because it's just a witty site. The site is clearly that. It's because E-Bay is now considering a lawsuit against the Simon sponsored website for copyright infringement. The site, although mimicking the E-Bay site, is clearly a parody. Parodies are clearly protected by the 1st Amendment- otherwise comedians like Jay Leno would be out of business.
The site purports to be a Gray Davis site that offers political favors to the highest bidder. The funny, or should I say sad site, part about the site is when you click on any of the links of the various items offered for bid, you get to see the real details, just like the real Ebay site. I Am Not A Lawyer, but methinks the lawsuit should be interesting to watch. I recall another case where the authors of a political flyer that mimicked the style of Dr. Seuss came out the loser in a copyright infringement lawsuit. The reason the fair use defense failed seemed to be that it wasn't a satire upon Dr. Seuss (as in this case, it isn't eBay that is getting satirized).

No viable choices? Read the candidates on the issues. You'll never find a candidate who agrees with you on 100% of the issues, but IMHO Simon is a clear win on the issues, on personality, and certainly on integrity.
The true shame is that the relentlessly leftist press is so pro-Davis.

I saw the site profiled on Taegan Goddard's Political Wire. They loved it, saying no matter who you're rooting for in the election, you've got to admire the wit and creativity involved with this site.
