>>>Where in this world is killing legal?<<<

Posted on 08/09/2002 3:47:42 PM PDT by Bowana

In a discussion on terrorism on another board, I was asked the following question, "Where in this world is killing legal"?

>>>Where in this world is killing legal?<<<

Right here in the good ole US of A and NH Too!

New Hampshire RSA TITLE LXII CRIMINAL CODE
CHAPTER 627 JUSTIFICATION
Section 627:4 Physical Force in Defense of a Person. –

II. A person is justified in using deadly force upon another person when he reasonably believes that such other person:

(a) Is about to use unlawful, deadly force against the actor or a third person;

(b) Is likely to use any unlawful force against a person present while committing or attempting to commit a burglary;

(c) Is committing or about to commit kidnapping or a forcible sex offense; or

(d) Is likely to use any unlawful force in the commission of a felony against the actor within such actor's dwelling or its curtilage.

From the New Hampshire Revised Statutes Online: http://gencourt.state.nh.us/rsa/html/indexes/default.html

In any situation above, the act would never be considered murder by any definition of the word. This would be considered a "Justifiable Homicide" or a justified killing.

In the following dictionaries; Merriam-Webster's Collegiate® Dictionary, The American Heritage® Dictionary, Oxford American Dictionary, and Webster's Revised Unabridged Dictionary, every one states that the definition of Murder is "unlawfully killing a person" or "to kill unlawfully".

Notice the legalese written in to the law, in general, using deadly force to defend yourself is only justified when the other party is in the process of using deadly force against you or another person. In other words your life or someone else's had better be in immediate eminent danger or you will be facing a murder charge.

Now in the case of burglary, kidnapping, a forcible sex offense, or the commission of a felony in your home, you or someone else only needs to be in "likely" danger.

The way I see it if you can't get the job done in 3 shots you shouldn't own a gun.

I know some people say that you should always Double Tap, but I prefer a 45 and aiming center mass.

So what are you doing playing on the computer on this fine summer day??

The Right of Revolution (From the NH Constitution)

Art.] l0. [Right of Revolution.] Government being instituted for the common benefit, protection, and security, of the whole community, and not for the private interest or emolument of any one man, family, or class of men; therefore, whenever the ends of government are perverted, and public liberty manifestly endangered, and all other means of redress are ineffectual, the people may, and of right ought to reform the old, or establish a new government. The doctrine of nonresistance ag ainst arbitrary power, and oppression, is absurd, slavish, and destructive of the good and happiness of mankind.

Yup! That's the one! And my favourite line:

The doctrine of nonresistance against arbitrary power, and oppression, is absurd, slavish, and destructive of the good and happiness of mankind.

The Netherlands.

The government there kills/euthenizes approximately 1,500 people a year without consent.

But then our own government has okayed the destruction of over 40 ,000 , 000 lives through abortion.

What's Your point?

If it's just selfdefense do as You feel and find out if the courts agree , at least You will be alive.

Ya now we just need the politicians at the state level to read the State Constitution.
Maybe getting the ones at the Federal level to read the US constitution and maybe the Federalist papers wouldn't be such a bad idea either!
