THANKS TO the wisdom of Baltimore attorney Andrew C. White and an Anne Arundel County grand jury, we now have some clarification on what does and does not constitute a "cap-able" offense in the eyes of law enforcement officers.
For those of you not familiar with current American slang, it's only fair to point out that there is no such word as "cap-able." It's an invention, deriving from the street lingo phrase "to pop a cap in the ... " - I'm told the rest of the expression can't be used in this paper - or, in other words, to shoot someone.

Seriously, one of the justifications which I read for letting Braga off was that in this era of terrorism, our Fed Swatties must NOT under any curcumstances be caused to "hesitate" in shooting when required.
So one or two peons killed or maimed is a small price to pay to ensure that our Swatties are ready to kill the next Mohammed Atta in a microsecond without flinching or pausing to reconsider.
I honestly read this in a serious article.

seems to me that the police department and Special Agent Bragga are wide open to a humongous civil settlement. And who foots the bill for THAT??! The taxpayers - i.e. you and me. Bragga will escape all justice for what he has done, just like Lon Horiuchi.

Since There are no PERSONAL penalties to this kind of thuggish behavior, the thugs involved have no reason to do anything different!

I suppose that one can hope that any judgment will be taken from the FBI's current appropriation, so that it will at least inflict some pain int that way.

It was in one of the earliest threads posted on the Braga shooting. Some "un named" federal source said that they were very concerned that if Braga was severely punished, it might cause a dangerous "hesitation" among the Fed Swatties, which we could not afford in the era of terrorism.

prod the FBI into teaching its agents a little elementary firearm safety The agents of the FBI and other Federal Agents get very good firearm safety training, and lots of "judgment training" including this type of shoot/no shoot thing. I don't think what we're seeing is a lack of instruction.
With tens of thousands of Federal LEOs running around with guns, not to mention that they frequently face really unpleasant people, there are sometimes going to be accidents -- law of averages. But that isn't what this case appears to be, either.
Braga presumably took this training and passed it. Despite the best efforts of the trainers, sometimes a sociopath slips through. Such an individual will not fire his weapon when he must like most responsible gun users. Instead, he will fire it whenever he can. With two shootings that don't pass the sniff test, I would say that Braga the individual is the problem, not the Famous But Incompetent (as other feds call his publicity-sotted bureau). If all the FBI were like him, there would be blood running in the streets.
It's sad the way that everyone closes ranks around a bad actor. It should be the coaches themselves that bench players who can't follow the rulebook.
