Defense Hopes To Show Child Porn Wasn't Downloaded By Defendant

SAN DIEGO -- A computer expert hired by David Westerfield's defense team said that at least some of the pornography seized from his home was downloaded by the defendant's son.
Marcus Lawson (pictured, right), president of Global CompuSearch of Spokane, Wash., testified Wednesday that he found two photographs of naked women and Japanese "anime" computer animations on the hard drive of a Gateway computer in an upstairs bedroom used by Westerfield's 18-year-old son, David Neal Westerfield. The former Customs Service agent said that a detailed analysis of the files showed the pornography was downloaded at about the same time someone was accessing an email account belonging to the younger Westerfield.
David A. Westerfield, 50, is charged with kidnapping and killing 7-year-old Danielle van Dam. He is also charged with misdemeanor possession of child pornography. Prosecutors have said the 80 or so images of child pornography taken from Westerfield's home indicate sexual interest in children.Defense attorneys are trying to show that the defendant is not responsible for the pornographic images -- including those of young children -- found on his computer equipment.
David A. Westerfield, a 50-year-old self-employed design engineer, is on trial for the kidnapping and murder of 7-year-old Danielle van Dam.
Lawson told jurors that he examined copies of hard drives, zip disks and compact disks made by police and took numerous screen captures -- essentially photographs of what came up on the computer monitor at a given time.
Defense attorney Steven Feldman asked Lawson if there was a theme to the animations.
"A considerable number of the screen prints showed bondage -- where women were tied in ropes," Lawson said.
A screen print of an e-mail to a DNWesthotmail.com, as quoted by Lawson, said: "Thanks for joining anime.com."
Lawson also confirmed screen prints the defense entered into evidence last week, that a computer in the office of Westerfield's house was used to access pornography on Feb. 4 at 4:47 p.m., when the defendant was busy with detectives.
Feldman mentioned last week's suggestion that the clock on the computer may have been doctored.
"Did you see any evidence that that happened on any of the computers you examined?" Feldman asked.
"No, I did not," Lawson answered. He said there's usually signs when a clock has been tampered with, such as files being accessed before they were created. Nothing like that was apparent on Westerfield's computers, he said.
Tuesday, San Diego police Detective Johnny Keene testified that he collected Westerfield from his Sabre Springs home that Monday around 3:40 p.m. and took him to the Northeastern substation in Rancho Penasquitos. The defendant remained there until approximately 11:30 p.m.

Your scenario makes alot of sense and the puzzles pieces sure fit in. My question is WHY didn't the LE think of this and WHY where they hell bent to nail DW when everything points to the VD(s)? There has to be more to this than just poor Danielle but what?

Do you remember reading a few thousand posts ago about Rich Brady telling D.W. at the bar," We know what you are about." Or something to that effect? How did this bit of info come to be known here?
I also saw somewhere the Rich Brady was one of those complaining about the D.W.'s MH being parked on the street,again ,something to that effect. I believe using these two statements(if they are true) Brady could well be the one that used his pointy mj stained finger to point the LE to D.W. or showed Brenda the way and she used her pointy finger to show LE the way.

It could be his son, or it could be one the party people. (Perhaps inebriated and accidentially killed Danielle with their car.). It's always bothered me that Brenda testified about Danielle & her jumping out to suprise Denise when she initially arrived, and then the story changed to Brenda was in the shower when she arrived. Weird...maybe the dog did it.

True but considering the sheeple attitude toward anything of this sort is not a big deal unless "serious" illegal drugs or child porn etc is involved. I always wondered about this plastic necklace she wore ALL THE TIME. I read somewhere that the mother said she wore it for two years? Does this make sense? If true, what child would want this on for that length of time? Why would her mother allow her to wear this cheap plastic thing when expensive pictures were taken of her? Why would a "retired" detective be the in between the VD(s) and LE? What gave her the power to "help" direct the investigation because that is exactly what she did. Why didn't the LE tell her to butt out. Was DW the only single male living near the VD(s)? The perfect patsy.......

All great questions. I hope they get answered but doubt they will. The VDs have a lot more support than DW has. In fact, I don't remember anyone besides his family, close friends and most posters on these threads believing him to be railroaded.

I think the 'alternate scenario' to Damon's testimony is dead on. (Forgive the pun.) And I think they're getting away with it because muckety mucks ordered it. Maybe Halfman's presence wasn't as FOVD, but rather, FOSDPD.
I don't think she was accidentally killed in the driveway, too much evidence in the house. I think the Boo Story is another important piece of misinformation, but I don't know why.
The poison oak may have just been one too many cute touches that seem to permeate this sick, sad story.
Rheo, maybe we should make a 1:15 p.m. phone call, during lunch, to demand to know about the dog bed.
I doubt BVD was involved in Danielle's death, but I suspect she helped devise the cover-up, or was deputized by Halfman to see that it was carried out.
Maybe Jeffery Toobin will write a book to uncover all of these mysteries. sarcasm/off
Thankfully, there's no statute of limitations on murder. Damon must be sleeping with one eye open these days.

I just read BVD's testimony last night. She testified that at Dad's DW asked her why Rich said to him "I know what you are all about" (or something like that.) She told DW she had no idea. I wish I knew what that was all about! Is it just more smoke?

I always wondered about this plastic necklace she wore ALL THE TIME. I read somewhere that the mother said she wore it for two years? Does this make sense? If true, what child would want this on for that length of time? Why would her mother allow her to wear this cheap plastic thing when expensive pictures were taken of her? I too am puzzled about the necklace.
#1 -- Cheap jewelry, plastic or otherwise, usually breaks in a very short time. How in the world did she wear it 24/7 for 2 years?
#2 -- Most mothers would have at least "asked" her (Have you noticed how the VDs always "asked" their children and never "told" them to do anything?) to take it off for bath and shampoo, to make sure she was clean. Think about the 'tan line' on your wrist from wearing a watch and your fingers from wearing rings.
#3 -- I agree bigtime about wearing the necklace in those Heirloom portraits. I know how expensive they are!

I really don't think the VD(s) have all that much support. It only looks that way because of the bias of the Media. If you notice only two neighbors came forward for the prosecutor, Ms Busybody and Granddaughter/Grandpa which by the way did not say anything negative toward DW. I have not heard anything else from the neighbors with the exception of the two testifying for the Defense. It seems that no one really knew the Van Damns on "purpose" whereas DW seemed to be a good neighbor. I'm sure if there wasn't a gag order there would probably be alot more stuff coming out regarding the VD(s). I'm in San Diego and alot of people do not think that DW is necessarily guilty. In other words, we are waiting for the Prosecutor to prove it. You know the old standyby "innocent before proven guility".
