If neither party is willing to make even a token effort to save a marriage (especially given that such effort would put them in the position above of the party who wants "in") I don't think there's any hope for it. Saying both parties are to blame is all very well, but unless you would have the state confiscate the people's assets it matters little whether both or neither are at fault.

If, from the beginning of the marriage, each partner knows that there is no way out without losing everything, you will never have the situation where both want out. Either one will commit adultery or both will commit to making the marriage work. Of course from now till then some people will be stuck in unhappy marriages but they have the choice of making them work as best they can or leaving the marriage and losing everything. Last one faithfully in the marriage wins all.

As long as they are both alive there is hope for the marriage.

community property means if you are married one second you are automatically entitled to half.

Equitable distribution is better because it is more flexible. It also reduces the short term marriage for profit issue.

that is called "equitable distribution" however the equities can alter the distribution.

Unfortunatly it is often a question of maintiaining the marital lifestyle. Consideration includes, earning ability and sqandering marital assets on an affair.
