I wish ... it will take the whole of the 9th though. I cannot imagine that the three member panel of judges were not aware of this ... I cannot imagine the defense not bringing it up.

Either incomptetence ... or pure activism from the bench. I believe it is the latter.

The 9th has a horrible reputation for activism (and for being overturned by the Supreme Court thankfully.)

Well, they are GOING TO BE OVERTURNED on this one too!

The fact that they are so often overturned, at such a HUGE rate ... speaks to both their activism and their incompetence IMHO.
