I spent some time this weekend going over the PH transcripts...it's amazing the number of times Feldman indicated he had never seen this report or those photos or that sheaf full of technical notes from which witnesses were testifying. Important stuff, too, like how long stains were, procedures followed, fingerprint cards, where exactly something was found, or chain of custody of items of evidence. Slipshod, at best.

This seems to be an ongoing problem for Feldman. However, others would have you believe that it is just the opposite, despite the fact that Feldman still has to ask for copies of stuff during the trial. Go figger.

I spent a little time going over some of the trial testimony last night. One thing I noticed was how fast BvD "identified" DW's backyard, when the prosecution put the pictures up on the display board. If she had never been in his backyard, how could she ID it at a glance? How could she ID it at all?
Just a small detail, you say? True. One of many small details that make me go hmmmm.

I would suspect the discovery phase wasn't over during the PH...I wouldn't read too much into it. Besides, remember the rules of PH says the prosecution doesn't have to present all of their evidence at PH. Also, they had closed hearings about the evidence before the trial so the judge could make his decisions about what is evidence and what isn't. Just some thoughts to consider.
