Wrong, having a smoking section in a PRIVATELY OWNED restaurant is like telling someone they CAN pee in your PRIVATELY OWNED pool, if they want to.

#1.) All of the studies purporting to show a danger from second hand smoke, show just the opposite; that SHS is in fact benign.

#2.)The EPA study that classified SHS as a Class I carcinigen was invalidated by a Federal judge in 1998.

#3.)The subject under discussion is whether or not a property owner has control over what he can or can not allow ON HIS OWN PROPERTY.

#4.)If the peeing in the pool analogy is the best you can do, expect people here to ignore you. Come up with facts and figures and stop whining.

You have to consider the private property issue and separate emotion from the matter. Smoking/Flatulance is a better comparision because both actions expel volumes of gas that a lot of people find annoying, except for the ones doing it, yet public/private flatulance is not under attack, smoking is, go figure. Both of them burn my eyes anyway.

Yes you can pee anywhere in a public pool now. Lets restrict it to the area around the filter intake. As for smokers... let them smoke anywhere they want so the air will be as clean as the public pool water is now.
