Rep. Jim McDermott, Washington Democrat, has acknowledged leaking to the media a surreptitiously recorded phone call between Rep. John A. Boehner, Ohio Republican, and then-House Speaker Newt Gingrich.

A Florida couple used a scanner to eavesdrop on the December 1996 conference call in which Mr. Boehner, Mr. Gingrich and other House leaders discussed strategy involving announcement of an ethics committee finding against Mr. Gingrich.

Mr. McDermott says accepting the tape did not break the law and punishing him for making it public would violate his free-speech rights.

Then it should be OK to wire McDermott's home and office.

This POS SOB should go to jail along with the faux hayseed Martins who taped it.

Well, actually no. According to him, it's just OK to leak the tapes afterwards :)

Anybody think this will get the press and the live TV coverage Watergate did?

I didn't think so...

Don't miss this current article about the judge who leaked Lewinsky probe info (and Starr's team was unjustly blamed in the press):

House Chairman Wants Judge Probed

My favorite line from that AP article is that "(judge) Cudahy said in August 2000 he inadvertently told an Associated Press reporter during the Democratic presidential nominating convention for Al Gore that Ray had convened a grand jury to investigate whether Clinton should be indicted for false testimony. The AP has never identified the sources for its story."

Bet that AP still hammered the independent investigator for leaking information...

But the activist couple didn't even go to jail; they were each fine $500. It doesn't even say that their mobile call receiving and taping equipment were seized.

When laws (in this case Federal law) are not enforced - you have no government.

Here there is a "controlling legal" authority - but the odds of McDermott seeing any sanction (e.g., a fine or even jail time) are slim and none.

Oh, they just "happened" to be roaming around there and just "happened" to have the equipment which just "happened" to be set on the correct frequencies and they just "happened" to turn it on and just "happened" to have some recording equipment, too, already running, and just "happened" to know some interested Democrats...

And G.Gordon Liddy just happened to be in an apartment across from the Watergate in 1972 on the night of the break-in.

I don't know if there is a federal wiretapping statute. I say this because the particulars of wiretapping differ by state. Here in Texas a phone call can be taped if one of the participants is aware that it is being taped.

Remember that the left tried to go after Linda Tripp for taping some conversations she was having with Monica Lewinsky.

That said, this illegal act by a member of Congress is not protected by the First Amendment. I say get him out of office now.

Okay, so we pay somebody the $500 fine in advance and they wire his house and give us the tapes and we'll publish them in honor of our 1st Amendment rights. ;)

Actually $500 is kind of cheap when you think about it: let's do it to everyone!
