Prosecutor will make decision on any charges against FBI agent; Agency doing separate review.

Anne Arundel County police have submitted the results of their investigation into the FBI's shooting of a Pasadena man mistaken for a bank robber to county prosecutors, who are to determine whether criminal charges should be filed against the agent who fired the shot, officials said yesterday.

Police Chief P. Thomas Shanahan said the case will remain under investigation until State's Attorney Frank R. Weathersbee decides whether charges are warranted.

Yeah, right. I bet no charges are filed against this thug. Any takers?

Reports indicate the actual bankrobber had never been in a red car after the robbery, but instead had been in a green pickup. So the obvious question now becomes, where the heck did the alleged "red" Honda come from? What criterion for probable cause is being used before attempting an arrest? If the kid had shot the FBI agent because he mistook them for gang members threatening public safety, I have little doubt he would be locked up if not DOA.

I was always under the impression that powers of observation were a requirement for all FBI agents. This dumb schmuck can't even tell the difference between a Honda and a Pontiac. Of what value would this agent's testimony as a witness be in court if asked to recount his view of a crime scene? Doesn't speak well of the competence level of that agent at all.

Sounds like a very lopsided investigation if the detectives didn't even question the FBI shooter.

I'm not a lawyer but I thought it was obstruction of justice if an individual refused to disclose information involving a criminal investigation,pardon me, I forgot that this is Maryland and Annapolis, home of one of the most corrupt FBI field offices in the U.S., run by FBI Special Agent in Charge, Dave Midura and his corrupt side-kick FBI Special Agent, Marina Murphy.

The county report on the shooting does not include an account from the FBI agent who shot Schultz in the face with an M-4 rifle, high-ranking county law enforcement officials said.

Agent Christopher Braga, who retained a lawyer shortly after the shooting, declined to speak to county detectives,said the officials, who spoke on the condition that they not be named.

DA is also charged with determining the truth in order to protect the Public. Since the Feds are the ones suspected of wrongdoing, the Local DA helps to keep some degree of check and balance on the investigation. I'm glad to see the state and county NOT turn jurisdiction over to the FBI on this one. Helps keep doubt on credibility limited to those agents involved in the incident and allows senior law enforcement and institutions to remain intact.

That case is over,it has been swept under the rug and the fbi agent is now free to shoot someone else.

This was not his first shooting, he killed what was supposed to be a murder suspect who was unarmed when killed, but a gun was supposed to be found nearby.

If the kid had died, he too would have been a robbery suspect.

As to your bet that no charges will be filed against this thug. Would that fall under the title of "sucker bet"?

The local, state and Federal law enforcement agencies work hand in hand to protect not not only their own but layers and layers of corrupt politicians and organized crime.
