Police Chief P. Thomas Shanahan said the case will remain under investigation until State's Attorney Frank R. Weathersbee decides whether charges are warranted.

Yeah, right. I bet no charges are filed against this thug. Any takers?

He'll get promoted, like Lon Horiuchi after Ruby Ridge. Only to strike again, Like Lon Horiuchi at Waco.

Reports indicate the actual bankrobber had never been in a red car after the robbery, but instead had been in a green pickup. So the obvious question now becomes, where the heck did the alleged "red" Honda come from? What criterion for probable cause is being used before attempting an arrest? If the kid had shot the FBI agent because he mistook them for gang members threatening public safety, I have little doubt he would be locked up if not DOA.

"...got into a red Pontiac Grand Am, which resembled a red Honda Civic that an FBI informant had told police their suspect would be riding in."

In my book, a Pontiac Grand Am does NOT resemble a Honda Civic at all, even if they ARE both red!

"FBI officials have apologized for the shooting."

Yes, one should always apologize when shooting someone in the face!

Just speak into that hole there, yes, the one beside the left ear.

Yeah, that's it.

All better now!

I was always under the impression that powers of observation were a requirement for all FBI agents. This dumb schmuck can't even tell the difference between a Honda and a Pontiac. Of what value would this agent's testimony as a witness be in court if asked to recount his view of a crime scene? Doesn't speak well of the competence level of that agent at all.

"In what was a case of mistaken identity, "

That's an interesting take on the whole episode. A bit delusional, but interesting.

The FBI - HOW LOW CAN YOU GO !!!!!!!!!!!!!!!!

Sounds like a very lopsided investigation if the detectives didn't even question the FBI shooter.

I'm not a lawyer but I thought it was obstruction of justice if an individual refused to disclose information involving a criminal investigation, pardon me, I forgot that this is Maryland and Annapolis, home of one of the most corrupt FBI field offices in the U.S., run by FBI Special Agent in Charge, Dave Midura and his corrupt side-kick FBI Special Agent, Marina Murphy.

The county report on the shooting does not include an account from the FBI agent who shot Schultz in the face with an M-4 rifle, high-ranking county law enforcement officials said.

Agent Christopher Braga, who retained a lawyer shortly after the shooting, declined to speak to county detectives, said the officials, who spoke on the condition that they not be named.

That case is over,it has been swept under the rug and the fbi agent is now free to shoot someone else.

This was not his first shooting, he killed what was supposed to be a murder suspect who was unarmed when killed, but a gun was supposed to be found nearby.

If the kid had died, he too would have been a robbery suspect.

As to your bet that no charges will be filed against this thug. Would that fall under the title of "sucker bet"?

Schultz was wearing a baseball cap similar to one often worn by the suspect and got into a red Pontiac Grand Am, which resembled a red Honda Civic that an FBI informant had told police their suspect would be riding in.

The Feds will pay off the victim with millions of tax dollars, and the FBI shooter will not lose one day's pay.

If I recall correctly, didn't they wait an hour or so before calling for medical assistance, only after they realized they had the wrong guy?

Reposting my comment from this thread when it happened... it doesn't look like the FBI has addressed any of the major problems:

For review purposes, let's go over the list of crimes, mistakes, poor condict, and hubris in this small event.

Those who are properly trained in the use of firearms do not rest their finger on the trigger, nor do they allow the barrel to point in any direction that might be unsafe. Those who refuse treatment suspects (and some reports mention gloating about it) deserve to lose their job entirely.

The three major points here:
1. The laws of the land should apply to all citizens equally. If any of us had mishandled a firearm during a gunshow or at home (or any acceptable reason to have a weapon drawn, just like when a pursued perp has shown a weapon)... and someone got shot in the face... then we would be in jail, facing fines, and would certainly be fired if handling of the firearm was a part of our job (like a salesman or instructor).

2. The FBI needs to stop covering their agents' crimes. They serve the public. The FBI should be open and honest when mistakes happen, and should demote, prosecute and fire agents when merited.

3. The FBI needs to ensure that those who need medical attention get it as soon as possible, whether they are suspects or not. The teacher at Columbine died and the kid in this story could have died because they are not willing to perform the same tasks that local officers and firemen do every single day: go into an area to try to save a life, even if an element of risk exists. (I'll refrain from using the WTC as the basis of comparison, again to be as accomodating as possible in my arguments.)

Rather than serve the public with truth, honor, and self-improvement, the federal agencies (as well as Congress) prefer to lie, obfuscate, 'CYA', and show their disdain for the opinions and welfare of the public. The icing on the cake: the annual demand for more of our hard-earned dollars so they can 'do more'. Boys, we ain't gonna put up with it much longer.

Thanks for catching this. Been waiting.

God bless the Sun for being the ONLY establishment news org to cover this. I've e-mailed it to Rush and Drudge numerous times and they won't touch it. Makes me ill.

I just sent the following note to the Sun. I encourage FReepers to contact them as well.

****************************************

I wish to forward my heartfelt thanks for your coverage of this story. I have been following it closely along with the thousands of concerned citizens who comprise FreeRepublic.com.

As far as I know you are the only established news organization to cover what should be a national story. Please, please do not let the FBI and the corrupt agencies of your local government cover this up. I hope you understand how crucial this one incident is.

We are plunging headlong into a police state and though this is only one incident it is pivotal. The FBI have no excuses here. They went off half cocked, failed to make a standard (safe) felony stop and then torured the victim after the fact. Additionally they abused and traumatised the victims girlfriend as well.

This story must be put before the people and at least YOU are doing your job. I just wish the rest of the media would do it's job instead of working to promulgate the federal police state threatening to consume our once proud republic.

The thing that troubles me is the fact that the FBI's story is one logical fallacy after another.

The central point of this entire investigation is this "Was the FBI agent justified in taking that shot? Yes or no?"

Red car, green car, Mercedes or Yugo, perp, suspect or innocent bystander, all of this is window dressing. Was this a "good shoot" or not?

Given that this was an innocent individual, attempting to properly react to the directions given by a "law enforcement officer", I tend to believe that he was not acting in a "threatening" manner.

Therefore, even if this were a perp, this was still a "bad shoot".
