U.S. Taliban fighter John Walker Lindh returned to federal court on April 1, 2002 as his lawyers battled with government prosecutors over what kind of evidence can be used in his conspiracy trial. This picture, released by Lindh's lawyers on April 1, 2002 as part of the evidence, was taken by the US government when Lindh was at Camp Rhino in Kandahar, Afghanistan, in December 2001. Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted.
Yeah, shame for him that he was caught on a battlefield in a foreign nation instead of US soil, where your quote would have been relevant.

He could easily have snuck back into this country, if he had a long envelope and two first class stamps.

Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted... on Johnny Taliban's jailers.
Which is why his clothes had to be immediately removed for delousing & his arms held down lest he blow the interrogating officer away with his Islamic BO.

I was under the impression that he was an American citizen being tried in the American court system.
He is now.
That picture was taken in Afghanistan, where the US Constitution does not apply.
Learn, then opine.
