"Betting it'll be life. They would have discussed the death penalty longer." Several reasons to think that it'll be "life" and yours is pretty far down the list. Number One is that, in Tejas, you must prove that the convictee would be an imminent menace to society if not executed, a standard I don't see anyone arguing vis a vis Ms. Yates.
Secondly, I don't think this jury wants what would surely be a "messy verdict" - i.e., one that would lead down the circus path of endless appeals and a riotous orgy in the media. "Life" avoids all that. It's a crisp, clean sentence, and one not likely to be overturned.
Third, there is enough evidence on the record to engender at least some sympathy amongst the jury members, and the sentencing phase is where this kind of testimony has its greatest weight, usually.
For those reasons alone, I expect that the jury will expectorate a life sentence.
