Forest Service officials knowingly used faulty data of spotted owl habitat to block logging in a California forest, according to court documents obtained by The Washington Times.

The Forest Service did not have a "rational basis" for halting the timber sale to Wetsel-Oviatt Lumber Company, said the previously undisclosed ruling by Federal Claims Court Judge Lawrence S. Margolis.

Most papers will only print 200 words or less (from conservatives, anyway) so try to trim it down.

We get 250, but I was thinking about trimming it down, anyway. Thanks.

As he drove through the forest, Mr. Verner said, "I had the feeling I was never outside a stone's throw of suitable foraging habitat at least."

This is their idea of an "expert" witness?

They get Miss Cleo to testify as to the accuracy of the study?

Why have I been thinking about the Ceausescu's a lot lately?

Am I the only person who finds that headline grammatically odd?

No. The word "knowingly" brings human motives into what would have otherwise been a simple statement of fact.

Adding the word "knowingly" means either that someone knew the data was faulty yet allowed it to be published anyway, or falsified the data for some reason, and now has been discovered. It could also mean that a third party did the discovering. It's impossible to tell whether it was an honest mistake or a conspiracy of some kind from the headline.

A proper headline would have read:

"Owl Data Knowingly Falsified"

or

"Errors discovered in Owl Data"

Don't feel bad, such headlines are typical of the dumbed-down "journalists" who "write" for newspapers these days. Their college degrees are equivalent to what people of my generation (I'm 55) learned in grade school, as I point out every day to the 20-nothing graduates I work with, who don't know the speed of light, how many sqare inches are in a square foot, whether the Korean War was before or after WWII, or which is bigger, 1/3 or 1/4.

Don't get me started...

Owl stats? Never had 'em. Are they anything like mountain oysters?

Another group of liars get caught!

...but will not be prosecuted for fraud. They will not be prosecuted for destroying the lives of thousands of loggers, mill workers, and supporting businesspeople in Northern California and Southern Oregon.

How many times will a miscarriage of justice have happen before you will admit that Ashcroft is violating his oath of office at best, or is just as corrupt as Reno at worst. For the "top law enforcement officer" in the country to look the other way over this is a crime in itself.

Go ahead and flame me if you want for being an independent rather than a republican, but these people should be prosecuted. I will be very pleased if that happens, but it won't.

What do you think?

Being an honest person (some would say naive) it is still hard for me to believe that many people are so twisted that they are motivated by death, not life. I still have trouble believing it, but less and less as I get older. The evidence is becoming overwhelming that Ayn Rand was right in 1957 when she wrote in Atlas Shrugged [HTML added]:

They desire nothing, they hate existence, they keep running, each trying not to learn that the object of his hatred is himself....They are the essence of evil, they, those anti-living objects who seek, by devouring the world, to fill the selfless zero of their soul. It is not your wealth that they're after. Theirs is a conspiracy against the mind, which means: against life and man.

Ayn Rand, "Galt's Speech" from Atlas Shrugged, 1957

"junk science"

We should all give a word of thanks to Judge Alex Kozinski of the 9th Circuit Court of Appeals for the "Daubert v. Merrill Dow" decision, in which the good judge single-handedly drove a wooden stake though the heart of junk-science in the courtroom.

That Bush didn't nominate him to the supreme court is a crime.

SPOT ON!!!!

It is about time that we demand the same responsibility from government employees that we demand from employees in the private sector.

NO MORE FREE LUNCH!!!!

The compensation to the timber companies, ranchers, farmers, et al, who suffered directly from the false data and junk science, does not remedy the damage suffered by communities, businesses, and individuals who have been adversely and permanently harmed by this environmental terrorism.

There are individuals in government employment who are criminally and financially liable, as well as some other individuals who perpetrated and/or profited from, these crimes against the people. Until some heads roll and some ill-gotten monies and assets are seized, it's not over.

But the scientists did not verify their findings with a ground inspection.

Would the results have been different?
Little by little these junk studies are unraveling.

The judge found the employees "knowingly" went forward, because two studies, one independent and one by another federal agency, found the information faulty and acted anyway. It's in the article.

. . .Wetsel-Oviatt . . .

This lumber company is located in my home county. There should be a write-up in the local paper. I'll keep an eye out. Thanks for the ping. I heard Rush on this today and was expecting something here on FreeRepublic . . .again, thanks!

Thanks for the ping. I guess I'm being shunned by some of my ole friends who forgot all about pingin me. As you may, or may not know, W/O was one of my biggest supporters in my political escapades in this "lost cause" County!

Way to go Cecil!!! The problem is... the court of claims that also decided largely for Wayne Hage as well, took nearly ten years to rule. By the time the courts decide in favor of those being tormented by EnvironMentalCases, the damage is immediate and irreparable.

Yet, they get instant orders from the bench whenever they ask to stop whatever legitimate enterprise is going on. This system is so lopsided, it SUCKS!!!

Quit yer whinnin' I pinged you back at #28 or so, and you just slept through it! :o)

"...Yet, they get instant orders from the bench whenever they ask to stop whatever legitimate enterprise is going on."

You can thank ol' Jimmuh Cee for that state of affairs. - We need to do a super freep on those judges and shout them off the bench by demanding impeachment. Those same judges are doing damage in so many other areas, it would be a worthwhile effort.
