Windshield death suspect back in jail

Bail raised to $250,000; FW woman taken into custody for third time

03/09/2002

By NANCY CALAWAY / The Dallas Morning News

FORT WORTH - A woman accused of hitting a man with her car and leaving him to die, entangled in her windshield, returned to jail Friday when a judge raised her bail from $10,000 to $250,000.

Video
Chante J. Mallard, 25, was booked into the Tarrant County Jail on Friday afternoon on a murder charge the third time she has been incarcerated in 10 days in connection with the October death of Gregory G. Biggs, 37.

Even if the bail is met, Ms. Mallard will spend the weekend in jail. Probation officers in charge of monitoring bond conditions cannot pick her up until Monday morning, said Lt. Mack West, jail supervisor.

Her bond conditions, which 371st District Judge James Wilson set during a hearing, include being under house arrest at her parents' Fort Worth home, wearing an electronic monitor, no driving, no alcohol use, and drug testing three times a week.

Judge Wilson also placed a gag order on Ms. Mallard's lawyer and on prosecutors in the case. Her parents attended the hearing but declined to comment.

Ms. Mallard, a nurse's aide who was fired Thursday after the murder charge became public, sobbed in the courtroom and continually dabbed her eyes with a tissue before sheriff's deputies led her away.

During the hourlong hearing, defense attorney Mike Heiskell brought Ms. Mallard's parents and her brother, a lieutenant with the Fort Worth Fire Department, to testify about the former Girl Scout's willingness to attend future court proceedings.

"I guarantee you she's not going anywhere. She doesn't have anywhere to go and doesn't know where to go," Mr. Heiskell said, asking the judge to "look past the emotion and determine what is right and just."

But Assistant District Attorney Richard Alpert argued that the $10,000 bond Ms. Mallard posted Wednesday was insufficient and that she has an unstable work history and sought counseling only after she was charged in Mr. Biggs' death.

"It's no secret the community is outraged by her actions," Mr. Alpert said. "This defendant has friends who helped her cover up the crime."

Police said Ms. Mallard struck Mr. Biggs in October as he walked along U.S. Highway 287 near the Loop 820 split, and then drove home with him entangled in her windshield.

Although he was severely injured, Mr. Biggs, a former school bus driver and bricklayer who was homeless at the time of the accident, was not dead, police said. Ms. Mallard left him trapped in her car, which she hid in the garage of her home on the south side of Fort Worth, investigators said.

Police said that Ms. Mallard repeatedly apologized to the injured man, checking on him several times over a two- or three-day period, but that she never summoned help. After Mr. Biggs died, Ms. Mallard and at least one friend dumped his body in a nearby park, where he was found Oct. 27, police said.

A woman came to police in February, saying Ms. Mallard admitted to the crime at a party, police said. Investigators questioned Ms. Mallard and arrested her Feb. 26 on a felony charge of failure to stop and render aid.

Mrs. Mallard posted a $5,000 bond that day, but she was arrested a second time after police upgraded the charge to murder Wednesday. She was released that day after posting a $10,000 bond.

A trial date has not been set.

Police said Friday that they are continuing to investigate the case and are looking for anyone else who may have helped dump Mr. Biggs' body.

Why isn't the black community helping the informant? She's scared for her life. It makes you wonder about the black community in this area.

The murderer didn't have any trouble finding people to come to her defense, but the informant fears for her life. The black community should come together and show some solidarity behind the informant.

Where are the homeless advocates who will be raging on about this special interest group? Could it be that they don't have a spokesperson and/or a lobby big enough to get attention? Perhaps if they were covered by federal law as a "protected class" they would have more clout.

Sorry - just part of my long-term plan to see that every American is included in some protected class. That way, all hate crimes laws will apply to everyone. Hey - it's the only way to get liberal judges to pin stronger sentences on criminals......

"Those white people don't usually care about the homeless"

Would not suprise me. But the issue here is not that he was homeless, but that he was murdered.

According to the New York Times, she was not only an "honor student," she was an "A student":

Well that changes everything. Not only should she walk, she should also receive an all expenses paid world cruise. Poor little thing. lol

It probably wasn't race unless she drove into a white man intentionally. Hate crimes based on race are stupid anyhow----it doesn't matter if the victim was white or black, she is a cruel inhumane monster who could not help a fellow human being.

How interesting. From your link (giggling at the par-tay), I noticed the press has changed the spelling of this Girl Scout's name, from "Shantae" (is this the spelling on her birth certificate?), to "Chante". Could this be a deliberate ploy to make our Sunday School standout appear to be more cultured?

"What was that movie where you got points for killing pedestrians?"

Wasn't the Mad Max with Mel Gibson?

The bleeding heart liberals are in a quandary over who to speak for in this situation - a black woman or a homeless guy. The jury is still out on the compassionate worth meter.

But how do we really know that this person did not in fact intentionally hit this guy because he was a white man in a black neighborhood.

I don't think she intentionally hit this white guy. She was high on drugs and drunk at the time.

I believe is it was an accident, which happens all the time.

The problem is she left him to die a slow painful death, which she deserves life in prison for murder at least.

Comments?

Brilliantly articulated. I am impressed. I was walking by the U.S. Courthouse on Trade St. in uptown Charlotte yesterday and saw about 10 women holding signs that said "Fight the Radical Right", and "NOW", and "Keep Abortion Legal". I stopped and listened to them for a few minutes. Then I said "What about the children?" And "I'm a conservative. Why do you want to fight me?"

One feminist whipped out her cell phone and screamed at me, "You can move along! I'll call the police!" I said -- "America is a free country. This is a U.S. Courthouse. I am a United States Air Force serviceman. I choose to stand right here and express an opinion. Do you wish to remove my right to disagree with your child slaughtering agenda?" I had to get back to work but as I walked away I said, "I may have to go to Afghanistan to fight terrorists. I don't agree with what you say, but I'll fight to the death to ensure that you have the freedom to say it." I couldn't help but notice the hatred in their eyes...

The perpetrator showed absolutely no sign of humanity by not getting the vicitm help. It would have even been more humane to kill the guy right away rather than to let him stay impaled in her windshield for days to die of shock and blood loss. It's mind boggling to think that any human being can be so self absorbed and cruel.

This story is not unlike the story of the black woman in California a couple of years ago who had a boyfriend that kidnapped a white woman, and put her in the trunk, left her in the trunk.

The black woman did not do anything to let the kidnapped woman out of the trunk, and turned up the radio whenever the kidnapped woman pleaded to be let out. The kidnapped white woman eventually died as a result of drinking the antifreeze that was in the trunk. The black woman drove around for days with the dying kidnapped woman in her trunk, and never gave a thought to helping her or letting her out of the trunk.

Not everyone in this world is nice.

I'm just suggesting it was not race that motivated her.

Let me clarify?

I'm just suggesting it was not race that motivated her to hit him with her car.

But, why are you so sure she wouldn't have gotten medical care for the guy if he was black? Would she have giggled about keeping a black guy bleeding to death in her garage to her friends? I think not.

I totally agree.

Well, let's see if I can explain this. Due to the fact that blacks are the ultimate victims, bar none, her victimhood far surpasses the homeless man's victimhood. Therefore, her crime was not a crime, it all equals out in the end and she .... oh, I give up, using Dim logic is too d@man complicated and makes no sense.

I don't think she intentionally hit this white guy.

But how do you know that? Could it be that black people are not capable of doing such things? But of course us white racist guys form that kind of intent all of the time.

"The problem is she left him to die a slow painful death, which she deserves life in prison for murder at least.

Simply goes to intent to commit murder, or at worst aggravating circumstances.

One of the earlier reports stated her boyfriend and a friend of his, helped move the body to the park.

Did you watch Mr. Biggs' son on the TODAY Show. NBC's David Bloom was amazing to watch. He tried so hard to get the son to say something harsh, something angry, and he was totally perplexed when this young man answered each question, succinctly, assuredly, and without faltering.

The jest of the interview:
This handsome young man, who looked about 20, maybe a little younger, is not angry with the woman. He refused to speculate on the legalities. He said he wants to show Jesus' love to this woman, by his reaction to what she did. He wants the world to know that his Dad was loved and cared for by his family, that he was a real person.

He knew his Dad was dead since October, but he didn't know until this last week anything about how he died. Someday, he hopes to be able to talk to this woman.

By media standards, this WOULD be a hate crime if he were black and she were white. Now it's kind of ho-hum, it's happened, let's move along. Nothing to see here.

OMG! If reports are true, this man was in agony for at least 1, perhaps 2 to 3 days, and this unbelievable woman checks on him and apologizes? As my daughter-in-law says, she must have had a brain farht--no other explanation----unless, perhaps----racism?

I could be wrong, but I'm not sure this woman would have sought help if the victim was black?

My guess is that she would have done the same thing regardless of the race of the victim because her sole concern was herself.

The media, however, is guilty of a double standard in reporting this case, because you can be sure that if the races of the victim and perpetrator were reversed, that the media would literally be screaming bloody murder.

Oh, don't worry, the black community will show solidarity alright. At jury selection time. And again at verdict time. This bitch has a good chance of walking off scott free. Can you say, "OJ"?
