Ninth Circuit to See Vince Foster Body Photos in AJF FOIA Suit

In the Foster section of my web site is a new letter and declaration from the DOJ and OIC stating that they are enclosing, under seal, color copies of the 10 photos for the court's ex parte in camera review in response to the Ninth Circuit's instructions and that they will bring the original photos to the oral argument for the court's inspection pursuant to the court's instructions. Thanks Allan. They say the copies are "true and unaltered". I wonder if they mean like the Medical Examiner Field Report that whited out "neck" wound and changed it to "head" wound. You know, the one where they forgot to alter the second page? That one.

The three official versions of that report are before the Ninth Circuit in this case. I showed them that the version in the possession of the Office of Independent Counsel does not have the apparent remnants of what may be whited-out letters and that the OIC has shown no concern over that fact.

I do think it is connected to WTC bombing #1, though. History has a way of connecting these events.

What grounds are being asserted for not releasing to you the photos in dispute? What findings did Judge Keller make in the District Court?

The short answer is that the government and two members of his family are claiming that release of the photos will cause the family emotional distress and thereby violate their right of privacy. Keller found that 5 of the 10 photos would cause them such distress. The privacy issue is fully briefed in the August and April 1998 appellate briefs that are on my web site in the section for this lawsuit.

In its July 2000 published opinion, the Ninth Circuit said that the privacy exemption to the FOIA is triggered if the documents will disturb the family members' memory of the deceased. The latest briefs by me argue against the logic of that holding.
