Adult Stores, Threatened With Huge Fines, Vow to Remain Open

Daytona Beach, Florida (CNSNews.com) - Several adult-oriented businesses are embroiled in a bitter feud with Daytona Beach, Fla. officials who have ordered them to shut down or pay a hefty price.

Three adult stores, XTC Adult Supercenter, The Banned Bookstore and House of Leather were warned to cease offering sexually explicit merchandise or they would be fined $1,000 a day. Four adult clubs have been given a harsher ultimatum -- cease and desist altogether or be fined up to $5,000 a day.

The dispute landed in federal court over the summer, with the businesses suing the city over ordinances which control where such adult-oriented businesses can be placed. Late last month, a federal judge ruled the city could not shut the businesses down, but could levy fines as it saw fit. City officials recently began issuing notices warning about the fines, which are scheduled to take effect this week.

"All they have to do is shut down to avoid the fines,'' said Mayor Baron H. Asher.

The business owners, however, are adamant in their refusal to comply. "The deadline is bogus," said Mike Piscitelli, an associate with Ellenton Video Inc., which owns the XTC. "We're aware of their ultimatum and we know that they can issue citations up to $5,000 a day. However we are absolutely never leaving this location, under any circumstances or conditions.''

Ron Krenn, owner of Molly Brown's I and Molly Brown's II, a bikini dancing club and a nude dancing club respectively, echoed those sentiments.

"We're staying open no matter what," he said. "This whole thing is a circus show. They think they're going to fine us out of business, but we're not going anywhere."

Krenn said city officials have gone as far as fabricating violations to drive him out of business. Molly Brown's I was issued a $2,500 fine for one its female entertainers showing too much skin.

But Asher denied the fine was trumped up and said the city intends to fight until the end.

"We don't intend to back off one iota," Asher said. "We are going to rigidly enforce our zoning ordinances and land-development codes. Period. Exclamation point."

Asher added that if inspectors can prove the adult clubs, which include two others named The Pink Pony and Lollipops, remained open between the time of the first fine until the code board's December meeting, each will face a $100,000 fine.

I guess his store is normally quite peaceful and calm, rather like a church social.

Yes. I would think that I am in a very small minority. That being someone who needs a van when he shops at the porn store!

No really, now that I think about it, I can not think of anyone I know with a minivan that does not have kids.

I have 2 dogs, but it is mostly for hauling crap and for my extensive travel for golf tournaments.

Once they shut down all the porn stores, the next step is to address the outrageous public indecency of all of the women who walk around absolutely naked underneath their clothing and undergarments - even when they're at church, or around children! We just can't have this. The obvious sensible and morally correct solution is to make women wear clothes over top of their clothes.

Hey! I have no kids and I drive a minivan. And I drive it to the porn shop! Makes my purchases easier to transport home.

Why not just put the blow-up doll in the passenger seat of a convertable, or on the back of a motor cycle. Its even more fun if you carry on conversations too. Just dont let those red-light cameras get you.....

IF you will notice, the Libertarians and Liberals who support the Porn/Drug/Abortion/Homosexual Agenda on this forum will not debate you, they will only throw insults in your Direction claiming that you are the Taliban.

You are correct that the Founding Fathers did not allow this type of behavior, The Supreme Court of 1815 was brought to trial because of a LAW prohibiting the display of obscene material. Jesse Sharpless and the Others that were brought to court were brought to court under a CONSTITUTIONAL LAW.

Virginia had the Death Penalty for Adultery, Polygamy, and other Sexual imorality.

37 State STILL to this day have Adultery laws on the books, they are just not enforced like they used to be.

The Libertarians go hand in hand with the atheists who will attempt to rewrite American History to prove that the Founding Fathers support a Godless Immoral Society. Most of the Founding Fathers were devout Christians and they had laws on the books that supported the Christian moral code.

Answer this: Do you want laws that dictate what you and your spouse do in your bedroom? Do you want sexual immorality laws that tell you what positions you can use, etc? I am happy to know that no matter how much you get a stiff one whenever you think of the Taliban's Morality Death Squad's, you'll never get that here.

'...Virginia had the Death Penalty for Adultery, Polygamy, and other Sexual imorality...'

Yes, and like I said, so did the Taliban.

They also covered their women.

Should this store be closed?

and if the town's committees have the support of the voters, it's perfectly legal and okey-dokey, so long as it does not violate the constitution.

Not quite.
There is a clear distinction between democracy and mob rule. That's why we are a Constitutional Republic.

And that is droll: killing and raping and burning and mayhem is O.K. as long as it doesn't violate the Constitution?
What a puerile statement!

Please, how many porn shops do you think would operate in 1776? The operators would not be fined, they be hung!

Pretty flimsy argument.
The same can be said of selling TV sets, VCRs, GPS receivers, Air conditioners, stud finders...

Witchcraft, you know

Minivans are driven by people with alot of little kids. The person walking out the door was a typical housewife type....but I was pretty taken aback by what I saw.

Connect the dots.
A connection, maybe?
Where does this comedian think little kids come from?

I recall reading, I disremember exactly where, a line someone wrote that said, "missionary position only, without the lights on, no crying out or making other noises indicating pleasure. Singing of Onward Christian Soldiers is optional.

Personally, porn shops are not my speed, but as long as they are keeping it away from children, I have no problem with it. I am actually more concerned with the teaching of 'Fisting' and 'anal' sex to children by Public School systems.

Perhaps, just to be consistent, they should fine their public schools $1,000 dollars a day until they move out of town, too...

;0)
