KLAMATH FALLS, Ore. (AP) -- Claiming their civil rights were violated by a policeman warning of violence over shutting off water to farmers, two environmentalists filed claims Tuesday against the city for $100,000 each.

Because Lt. Jack Redfied was in uniform and backed by other police officers when he mentioned Andy Kerr and Wendell Wood by name, it appeared he had the backing of the city when he made the July 25 speech, attorney Gary K. Kahn wrote in a letter to the city.

Yea, sure I understand. Barbara Martin & Stan Thomson are in court in Eugene under a restraining order for peacefully protesting right NOW. Their water is under armed federal guard. Redfield has been demonized....and Kerr and Wood are pissing and moaning?????I'm taking a walk.

Right on the money, my oratorical friend. I remember the similar whines a couple of weeks back after that town in Utah passed its mandatory gun ownership law. A couple of greenie wusses pissed and moaned about it being an implied threat to enviro-wackos.

If you haven't seen the other thread, Stan and Barbara got 30 day continuances to better prepare their cases. They still can't pass the fence. Amom is enroute back and should be able to fill us in on all the details.

I am absolutely behind the farmers in this situation, but that police officer should be fired. He isn't helping anyone other than the environmentalists and the bureaucrats by making such idiotic speeches. Wearing his uniform, too! The city should dump this idiot.

Any money from the claim would be given to Indian and commercial fishermen hurt by diversion of water from the Klamath River to irrigate farms on the Klamath Project.

I believe that before the dam was built the lower Klamath valley was a swamp and there was a Lower Klamath Lake. So how much water wasdiverted?

You're quite welcome. I had to do something with my hands besides punch the walls. A couple of my co-workers just read this thread and I am busy learning some new and exciting (and exceptionally crude) phrases from them -- even some that I never heard during twenty years in the Army. I'm beginning to think I should write them down and save them for posterity...

So, Wood and Kerr are engaged in a conspiracy to deprive residents of Klamath of their civil rights. Did anyone think to sue these two guys for any one of a variety of things?

The officer was in uniform. While his statements would be appropriate once he clocked out and changed, he has an obligation to maintain a neutral posture while representing his department. And if he can't maintain his neutrality until quitting time, he can resign, change, then speak his mind.

Now tell me the truth, FN - if a uniformed officer had called for the confiscation of all firearms from private hands while on the city's payroll, would you be just as supportive of his "free speech' rights in that context?

Don't answer, I think I already know. You would (quite properly, IMO) be applying the JBT description to the officer and his actions. If so, does official misconduct magically disappear if the official says something you like?

Kerr is a consultant working with ONRC to develop support for a federal buyout of basin farmers to reduce water demand.

THIS Is how it starts. They buy out(at less, far less than what it's worth) then take over the whole damn thing.
