The Northern District of Texas strikes again, granting final judgement in a case with GOA and Silencer Shop Foundation to challenge the constitutionality of the National Firearms Act. The Judgement rules that because the government no longer collects a tax on short barrel rifles, short barrel shotguns, and suppressors, then their entire regulatory scheme is unconstitutional as it exceeds their authority as it no longer uses the enumerated taxing power

It is time to dismantle the ATF.
MSM will ignore it completely, basically it removes the ability to force the registration of small barrel rifles and suppressors.
Big defeat for gun control.
This judgement needs to be explained
Back in the 30s when the NFA was passed, Congress didn’t have the power to ban things, only tax them. (What a quaint idea, Congress only being allowed to do what the Constitution says it can do). Anyway, Congress did have the power to tax things, even to the point of effectively banning them by imposing a large tax.
The court’s reasoning, as I follow it, is since the taxes have been eliminated, the whole premise of the NFA, as originally passed is no longer valid. The NFA was not a ban on certain firearms, it was a tax on them. Take away the tax and the NFA disappears.
Does this mean we can buy sawed off shotguns with just 4473 and NICS?
Is the NFA the foundation of all subsequent gun control laws? Is this sweeping or merely targeting a single law from 1934?
So, some of DC is in panic mode.

There are a lot of things about DC that find ways out of abiding by the Law.

The judge, knowing the place of district judges (unlike Obama judges) did not issue a nationwide injunction. It just applies to the plaintiffs and its customers.
That said, it would eventually have national impact.

People here are all generally openly armed at Walmart and everywhere else, excepting bars, where you are supposed to leave your pistol in the car but no one does. Although, I have seen a cop tell a guy to conceal his heater under his jacket if he wanted to come into the bar.
Perhaps unsurprisingly, everyone is very polite and nice to each other. We have zero violent crime.
I take that back. Years back, we did have one bank robbery by a guy from Mexico that ended in about 8 people shooting the robber, from the tellers to random customers.
