Federal Judge Strikes Down NH's Proof-of-Citizenship Voter Registration Law

A federal judge in New Hampshire on Thursday ruled the state’s 2024 law requiring first-time voters in the state to provide proof of U.S. citizenship when registering to vote is unconstitutional.

The ruling by U.S. District Court Judge Samantha Elliott on HB 1569 is being viewed as a strong rebuke of the Republican-backed policy, considered by voting rights advocates to be one of the nation’s most restrictive laws regarding U.S. citizenship and the right to vote.

“New Hampshire’s interest in election integrity cannot justify the burden on New Hampshire voters based on the evidence in this case,” said Elliott in her 98-page ruling, released late Thursday...

The federal government could require up-to-date information on residence and citizenship be provided to the IRS.

The state could then check with the IRS when a ballot is requested.

I’m not sure involving the IRS in your or my voting rights is that good of an idea.

As James Comey recently pointed out, there are thousands of embeds devoted to #resistance, even in the FBI. How do you suppose the IRS stacks up?

That would be the same U.S. Senate that refuses to pass the “Save Act?” Good luck w/that.

The Federal District Courts have become a hotbed of Leftist activity. Their sole purpose is to delay the will of the people until another Leftist regime can usurp power. It's just another version of “the process is the penalty.” They don't care if they lose at a higher court level.

I am military brat born overseas. My mom and and dad are both Americans. I've served in the military, paid medicare and SS taxes all my life. I've had a US passport for 50 years and more recently a RealID. When I signed up for medicare a few years ago I still had to produce my state department birth certificate. LOL...

That’s why America has a Supreme Court... They make the final decisions with regards to the law and thankfully... They have been controlled by conservative justices who follow the established constitution for the past five decades or more.

Meaning these Liberal judges and their useless and lawless interpretations of the constitution are typically ruled as null and void by the Supremes

The problem with this "solution" is that there are thousands of liberal judges across the USA, all of whom can cause trouble for America, until SCOTUS can correct their bullshit rulings.

And the libs never quit.

I thought you had to have a REAL ID to get a driver’s license or board an airplane?

Does New Hampshire not have drivers, or has it nullified REAL ID rules as well?

As a day to day getting along question, it is a much greater burden to have to jump through these hoops to drive than it is to vote.

NH has voter ID, in my small town I have to show photo ID to vote even though I am known personally to the poll watchers.

The “manner of holding elections, for senators and representatives” may ultimately be prescribed by Congress.

Congress could require voters be registered with the Federal Elections Commission to get a ballot for a Congressional election.

The United States Postal Service, CMS, SSA, IRS, federal welfare program administrators, and state motor vehicle departments could work with the FEC.

You can still get on the plane with out a RealID or a passport but it costs around $50 to double check your identity.

of course it will be ... after the election.

They play this game every election. Laws are passed, then shortly before election some leftist judge throws the laws out. After the election, laws are ruled constitutional.

Then the same is repeated the next election. As long as they can get at least one judge to strike down the law before the election, they can continue to cheat in the current election.

In addition to real ID driver licenses, NH also grants on request non-real ID driver licenses, which are not useful for boarding flights or most real-ID requiring transactions.

This is helpful to our citizens who do not recognize court decisions because the courthouse flags have yellow fringe.

This year I showed my military ID as my driver’s license was expired . The license has since been renewed.

I wasn’t going to even try to use the expired license .

I have proposed that the Census Bureau, required under the Constitution to “count every person”, begin to track residents with the help of the Postal Service and its Informed Delivery ability.

The Census Bureau has had troubles including everybody in its counts.

There’s also the problem of people pouring into Florida without Florida getting a proportional number of Representatives until another decade has passed.

Doing a census every two years would help Florida get the representation its now huge population deserves.
