HHS secretary violated federal procedures in revamping advisory committee, judge says
A federal judge in Boston has temporarily blocked federal health officials from cutting the number of vaccines recommended for every child, and says Health Secretary Robert F. Kennedy Jr. likely violated federal procedures in revamping a key vaccine advisory committee.
The decision Monday halts an order by Kennedy -- announced in January -- to end broad recommendations for all children to be vaccinated against flu, rotavirus, hepatitis A, hepatitis B, some forms of meningitis, and RSV.
Leading medical groups voiced alarm at the changes. The American Academy of Pediatrics and some other groups amended a lawsuit filed in July, asking the judge to stop the government from scaling back the nation's childhood vaccination schedule.

Third, it claims the judge found changes to both the vax schedule and also that appointment of vaccine-board members were “probably were illegal” but doesn’t like to the judges rulings, nor gives any hint how these were “illegal.”
The “judge” in Boston is NOT named in the article. Some knowledgeable FReepers might look it up and get it posted on FR. This is one more example of a judge writing law and administering crap they know nothing about.
At least it’s not Boasberg. “A Federal judge in Boston”... so we all must lay down and assume the position. No, this is way out of a judge’s lane, once again.

A federal judge on Monday blocked Health and Human Services (HHS) Secretary Robert F. Kennedy Jr.’s changes to vaccine policy, including the reduction of the recommended childhood immunizations and his remaking of a key vaccine advisory panel.
U.S. District Judge Brian E. Murphy, a Biden appointee, granted a motion by the American Academy of Pediatrics for a preliminary injunction against the reduced childhood immunization schedule earlier this year, along with the remaking of the Advisory Committee on Immunization Practices (ACIP) for the Centers for Disease Control and Prevention, invalidating all votes made by the committee since.
Murphy found that the reconstitution of the ACIP last year failed to abide by the Federal Advisory Committee Act. He also found that the CDC bypassing the ACIP when changing the childhood immunization schedule was both a “technical, procedural failure” and “an abandonment of the technical knowledge and expertise embodied by that committee.”
“The Court concludes that, in addition to being contrary to law, the issuance of the January 2026 Memo was arbitrary and capricious because it abandoned the agency’s longstanding practice of getting recommendations from ACIP before changing the immunization schedules without sufficient explanation,” Murphy wrote in his ruling, referring to the CDC’s announcement at the start of the year altering the childhood and adolescent immunization schedule.
Last June, Kennedy fired all 17 sitting members of the ACIP, claiming it was necessary to “re-establish public confidence in vaccine science.” He went on to appoint a slew of known vaccine skeptics and critics to the committee....
Being broken on the wheel?
Well the temporary ruling was not about vaccines but rather did DHHS follow federal statute and regulation in reforming the committee. Bureaucracy protects and perpetuates itself through red tape.

That body is a threat to children and families. They have been totally conscripted by pharmaceutical companies. They also have embraced an agenda that is not only friendly to sexual perverts but they often carry water for them. They remain pro so called gender affirming care for minors despite evidence of the harms it causes.

I could be wrong but I believe the make up of the board was changed because of conflict of interest in relation to certain members and pharmaceutical companies. I could be wrong but I seem to remember Vinay Prasad, M.D. discussing this on one of his YouTube videos (which should still be available).
