DENVER (KDVR) — A slate of more than 80 of President Donald Trump’s nominees is on hold after Colorado’s Democratic Sen. Michael Bennet called out a Senate rule that temporarily blocked them from being confirmed.

A set of 88 nominees hit the Senate floor on Thursday, set to be considered “en bloc,” meaning all at the same time, after Senate Republicans in September changed the rules to allow mass confirmation of Trump’s nominees to escape Democratic blockades. That rule change, however, prohibited certain high-level nominees from being in these mass groups, and Bennet called out one such position that was in Thursday’s group to be voted on.

That position was the Director of National Drug Control Policy, for which Trump had nominated former Fox News contributor Sara Carter Bailey.

“I just blocked 88 Trump nominees from confirmation— including Sara Carter Bailey, a former Fox News contributor nominated to be our country’s Drug Czar,” Bennet said in a statement after making the move to block the nominations. “Bailey was nominated by Trump, who just pardoned the former President of Honduras, as he served 45 years in prison for conspiring to distribute over 400 tons of cocaine.”

Senate confirmation authority is specifically in the Constitution. The only way to change that is to amend the Constitution.

Gut feeling is that if the Administration can’t (or won’t) do something to put an end to this non-stop idiocy, it will eventually be done FOR them.

Or maybe that’s just last night’s substandard burritos making my gut feel strange. Heh.

Democrats are still blocking President Trump's nominees?

It's a coordinated strategy:

  1. Democrats block Trump's nominees in the Senate.

  2. Trump appoints an interim person to fill the vacancy.

  3. Democrats continue to block Trump's nominees.

  4. Trump's interim appointee's term expires.

  5. Trump appoints a new interim appointee while waiting for his nominee to be confirmed.

  6. A District Court judge rules that Trump's second interim appointee is illegal, and (in the case of prosecutors) appoints their own interim appointee or leaves the position vacant.

Senate confirmation authority is specifically in the Constitution. The only way to change that is to amend the Constitution.
The Constitution has already been changed.

When the Constitution was written, Senators were elected by the states. As such, the states were given confirmation power via their federal representatives.

But with the advent of the 17th Amendment, the delicate federal/state balance of power was thrown out the window.

Now any 2-bit tyrant wannabe can bring the entire government to a halt, if they manage to squeak by a state wide election.

The old Senate rules that were designed to guard against federal overreach into the states now allow radicals to undermine the foundation of our entire society.

It's high time for the Executive Branch to challenge the Advice and Consent clause, based on modern realities.
