President Donald Trump’s appointees in many agencies are trying to apply old laws in new ways to deal with the H-1B problem, says Eric Sell, a lawyer working for Assistant Attorney General Harmeet Dhillon.
“There’s a lot of will right now within this administration to address this problem [within the H-1B program], and a lot of it is new ways of enforcing old laws that are on the books,” Sell told a group of U.S. technology professionals on November 10. He added:
Just last week, Assistant Attorney General Dillon and I met with other high level officials within the administration to continue our coordination enforcement across multiple government agencies because it really is important that we build a united front with the Department of Labor, [U.S. Citizenship and Immigration Services], Department of Justice, to go after these companies and enforce our respective statutes to ensure that the law breaking ends and that American workers aren’t receiving the short end of the stick.
“We’re still exploring the best, most efficient way to use the tools that are available to us,” he told the group of American professionals who met in Washington to brief legislators and their staffers about the damage caused by the H-1B program. The group was organized by Kevin Lynn’s U.S. Tech Workers advocacy group for white-collar professionals.
The department is “going after the whales,” Sell said, adding:
We are going after the big fish here. They’re the ones who have sophisticated legal counsel and law firms on retainer who know know what the law requires and know what it prohibits, and if they’re flouting the law, then that’s a slap in the face to the Justice Department, to the people of this country and to the American workers who are suffering because of it.

The State of California is one of the nation’s #1 organizations that hires H1B visa holders and foreign contractors such as the fourteen North Koreans who were working for the state handling sensitive data.
Trump screwed up on that Ingram interview but if he kicks out a lot of h1b visa scammers than I think people will let it go. (Though that 600k red Chinese spy students is still a mistake)
I want to see a chart with h1b visas going WAY down
America has maintained its military superiority due its ability to research, develop and implement technological innovation. Unfortunately there is a critical dearth of Americans capable of doing this work. Most of our high school graduates who attend college are incapable of even basic mathematics. STEM programs are filled with foreigners. Unless cutting edge companies can get the manpower they need, there will be nothing for the Chinese spies to steal. Our military and the economy will suffer.
BTW anything that can be done to hold Disney for violating the law should be done.
Add to it the fact that Trump wants 600,000 students from communist China to be attending our universities and you know where his allegiances lie.
Then those who, despite an unrecoverably broken education system, are capable must navigate a maze of foreign cheap labor, set asides and preferences for minorities and women, lowball wages and outsourcing/offshoring only to face the prospect of layoff at any moment. In a rigged system the only way to win is to not play the game.
IBM did it too. Either train them or no severance.
This was an inexcusable, unethical, flagrant abuse of the law...................
“I want to see a chart with h1b visas going WAY down”
There are 30 different visas. They’ll find a way.
“Most of our high school graduates who attend college are incapable of even basic mathematics. “
They’re forced into the classroom with 80 IQ ferals who will never learn anything.
That’s have been industry standard practice for about 30 years!
Either send job to China or import cheap replacement here!
No wonder people vote for Trump!
I have another idea as well...maybe, just maybe...these large corporations, who enthusiastically spend tens of millions of dollars on DEI initiatives, ‘climate/green’ initiatives, and sensitivity training, should divert some of their resources to provide training to young people (who can be assessed via some aptitude test generated by the company) who wish to enter the workforce rather than attend college...
They aren't looking for "highly skilled Americans." They're looking for a handout. And they have no problem hiring H1-B's who are supposedly so "skilled" they need the Americans they replace to train them.
The American business class is right up there with US politicians as being the biggest liars and thieves in the country. Just about everything wrong with the country today is a product of their unholy alliance for "free trade," mass immigration, and driving US wages down while covering the class warfare with a fig leaf of DEI and "free market" ideology.
“Unfortunately there is a critical dearth of Americans capable of doing this work”
Absolute BUNK.
The State school Engineering programs are filled to the brim. At least 3 times as many as 45 years ago when I was there.
For virtually any engineering job in this country there are typically over 50 applications. Just look on Indeed, LinkedIn, etc and they display number of applications. One truly great EE that worked for me told me he applied to 130 jobs before he got a lousy technician entry level job and he went to a California State University with a well known program. Fabulous EE. In 1980, that kid coulda written his own ticket.
You’re repeating nonsense. There’s tons of kids who manage to do well in high school, take AP courses (Calculus AB or BC), still can’t get into the big universities: getting into ANY UC Engineering program usually requires a GPA over 4.0, 8-11 AP courses, extracurriculars like starting your own company, and a tear jerker essay. It’s more selective now then Med School in the ‘70s. And uh, it goes without saying...don’t mention that you’re White.
The foreigners you speak of are usually a) subsidized to come here, b) sandbagging courses they already took back home, and c) have networks where they share old tests, homework assignments and friendly TA’s who help them through while dumpin’ on Whitey.
Totally WRONG.
We had to sign a form saying we wouldn’t sue. They knew what they were doing and they didn’t care. The CEO got 30 million bonus that year.
