Bipartisan funding bill would allow senators to sue over government searches of their phone records

WASHINGTON — A provision tucked into the funding package the Senate passed Monday night as part of a bipartisan deal to reopen the government would allow senators to sue the federal government for potentially millions of dollars if their data is obtained without notifying them.

The legislative language would uniquely benefit eight Republican senators who were recently found to have had their phone records — but not the contents of their calls or messages — accessed as a part of the investigation that led to former special counsel Jack Smith’s probe of the Jan. 6, 2021, attack on the U.S. Capitol.

While the bill does not explicitly mention Smith’s probe, the language would retroactively apply to data requests that were made on or after Jan. 1, 2022, meaning the request for the Republican senators’ data, which was made Sept. 27, 2023, would be susceptible to a lawsuit...

It would be better to sue the individual perps responsible and make them pay.

What those senators did was not public service. The people involved should be prosecuted and sued, but taxpayers shouldn’t be paying for it because these senators are mad. It would be very bad politics for them to sue using this law, and the courts may be hostile to them, and rightfully so.

Peculiar how all the normal people whose rights were violated don’t get taxpayer money to pay for their law suits.

I agree!

The Senate missed the idea of the equal protection of the law. Senators should not have a privilege to sue the government that ordinary people lack. They just don't care about that, and it now becomes a legitimate campaign issue. They should be forced to change this law, or face primary challengers.

Not only better, it should be court ordered!
There’s no reason the taxpayers should foot the bill for this criminal act.
Those who ordered, and those who followed through with the act, should be sentenced to prison, after they’re stripped of everything they own, now, and in the future.
Relegate them to the poorhouse.
