The New York state attorney general was indicted on charges related to alleged mortgage fraud — but the case looks like an unconstitutional selective prosecution.
In the same jurisdiction in which the Trump Justice Department indicted former FBI Director James Comey more than a week ago, the same prosecutor who brought that case has now gone after another Trump enemy: New York Attorney General Letitia “Tish” James. (Disclosure: I worked as a volunteer member of James' transition team after her election in 2018.)
The reason for the indictment? James is accused of having falsified a mortgage application on a property purchased in Virginia. The extent of the harm she is alleged to have caused? About $18,000.
Whether the prosecution will ultimately be able to prove the case against James remains to be seen. What seems more likely is that James will be able to get the case dismissed, because it could be classified as an unconstitutional selective prosecution.

Looks open and shut to me, but i am not a journalist. Now the Trump case looked like it was based on flimsy and conflicting evidence at best, having been brought on grounds that are rarely prosecuted and was filed by partisan career lawyers within the Justice Department who were Democrats.
It only takes so many cross examinations of a defendant regarding “did you recklessly check boxes at random on the contract or did you intentionally lie?”
In the mid 1990s, my wife and I bought a farm while living in town. The farm had a residence which brought the 2nd home issue into play. When we were making the loan, the bank would not let us randomly check boxes before theyu explained every step of the contract to include the warnings about perjury and fraud. As to the “career lawyers” who objected? It wouldn’t be to difficult to research their history and see where their loyalties lie. DUH.
Finally, “intent”. We have a career “high powered” attorney who prosecutes people for this exact crime. Yet she unintentially commits the same crime? That’s gonna take some PT Barnum salesmanship on the part of her lawyers to sell that cow patty to any but an all democrat jury.
