Douglass Mackey celebrates official FULL acquittal, court apologizes…

The case against Douglass Mackey was always a sham. A weaponized DOJ tried to turn a meme into a federal crime. The same DOJ has also gone after January 6 prisoners and President Trump with political prosecutions. Different cases, but the goal was the same. It had zero to do with justice. It was all about political punishment, intimidation, and total control.

Yes, Mackey’s conviction was tossed out by an appeals court months ago… and overwhelmingly, by the way. But the story didn’t end there. In the days that followed, prosecutors had the chance to fight back, to appeal, and to try to reinstate the conviction. They didn’t. They knew they were beaten. They knew the case was flimsy and political and could never survive real scrutiny.

Even so, the official entry of Mackey’s full acquittal dragged on for nearly three weeks. Twenty days of silence before the court finally entered the judgment and actually issued an apology for the delay. That apology says everything about how weak and embarrassing this case was.

Revolver reached out to Doug directly, asking him how this exoneration impacts his life, his family, and his future. Here’s what he told us, in his own words:

“Although personally satisfying, this victory is for the American people. This victory is for all who donated and prayed and lawyered and spread the word to help win this case. It was an honor to stand for free speech.

After pouring many hours and hundreds of thousands of dollars into this case, I look forward to winning a settlement with the Trump DOJ, which is doing a great job righting the wrongs of the last administration. James Burnham of King Street Legal, who I’ve retained, is the right man for the job.

I’m also excited to announce I’ve retained Milbank LLP to pursue accountability and reforms within the DOJ and FBI. At the personnel and policy level, accountability is extremely important to ensure the DOJ can no longer do to any other American what they did to me.

My family and I are excited to move on with life and to have my freedom back. Freedom to vote, freedom to bear arms, and freedom to travel at home and abroad. I’d like to thank my wonderful wife and family for standing by me and supporting me in this fight.”

What happened to Douglass Mackey should have never happened in America. A young husband and father nearly had his entire life destroyed over a meme… all because the DOJ wanted a scalp.

And now, with Doug’s official exoneration, the tide is finally beginning to turn. Slowly. Doug’s case will go down as one of the most glaring examples of the left’s weaponized lawfare falling flat on its face.

But this victory is bigger than just one man. It’s about free speech, political freedom, and accountability. Mackey’s fight is a warning to every single American about how far the left is willing to go, but it’s also proof that the truth can still win.

This is only the beginning. Investigations, civil suits, and political fallout are coming for those who weaponized the justice system. Exposing them, stripping their influence, and making them face real justice is just the tip of the iceberg and will be a healing moment for America.

Looking into the notions of "under color of law" redresses, and it seems there are plenty, depending on jurisdiction in which a complaint is brought.

"Malicious prosecution" is a real thing, and there are a number of sites noting options: 1) compensatory damages, 2) emotional distress damages, 3) punitive damages awards when the prosecution was "driven by spite or retribution," and 4) reputational damage. And more than one can apply.

But if a civil complaint is lodged, then individuals can be forced to testify or plead the fifth which would indicate a potential crime was involved. But when testimony is about someone other than yourself, the fifth would not apply. Were I a pro bono civil rights lawyer, I'd be salivating.

Talk about burying the lede. Thirteen paragraphs and no explanation of what the specific charges were, what were the actions that led to the charges etc. The reader has to look at the picture that accompanies the article to ascertain some idea of these essential facts.

Well, I’m probably much older than you, and I do not live in the internet culture.

That said, I’ve been a prosecutor and jurist in a large blue state for a combined 50+ years, and still practice, although only in business litigation.

I have never seen a prosecution like this one, and it’s inconceivable that any resulting conviction would merit any custody time.

Times have changed.
