A memo from the agency’s acting director instructs officers to hold immigrants who entered the country illegally “for the duration of their removal proceedings,” which can take months or years.
The Trump administration has declared that immigrants who arrived in the United States illegally are no longer eligible for a bond hearing as they fight deportation proceedings in court, according to documents reviewed by The Washington Post.
In a July 8 memo, Todd M. Lyons, acting director of Immigration and Customs Enforcement, told officers that such immigrants should be detained “for the duration of their removal proceedings,” which can take months or years. Lawyers say the policy will apply to millions of immigrants who crossed the U.S.-Mexico border over the past few decades, including under Biden.
In the past, immigrants residing in the U.S. interior generally have been allowed to request a bond hearing before an immigration judge. But Lyons wrote that the Trump administration’s departments of Homeland Security and Justice had “revisited its legal position on detention and release authorities” and determined that such immigrants “may not be released from ICE custody.” In rare exceptions immigrants may be released on parole, but that decision will be up to an immigration officer, not a judge, he wrote.
The provision is based on a section of immigration law that says unauthorized immigrants “shall be detained” after their arrest, but that has historically applied to those who recently crossed the border and not longtime residents.
Lyons, who oversees the nation’s 200 immigration detention facilities, wrote that the policy is expected to face legal challenges. ICE did not respond to requests for comment. Customs and Border Protection Commissioner Rodney Scott issued similar guidance last week; that agency also did not respond to questions.

I’m dirt poor and get livid standing in line behind these big fat criminal families as they blow wads of cash on cart loads of designer-everything and foods I can only dream of.
The kids wear expensive shoes they’ll grow of in a couple months that cost more than a month of my meager groceries.
And then I feel bad for my anger because it’s seriously not Christian.

Perhaps, but the immigration courts are in the Executive Branch, not Judicial Branch, and this sounds like a solely immigration matter. As long as ICE follows its own laws, I don’t think any federal judge has a say.
Exactly. No more Marquess of Queensberry Rules. It tells them we aren't playing any more. Go home and try again, legally. No tying up our immigration courts for a decade, just go.
I worked for ICE in 2012-2014. In 2014 they would bond out and have court appearance dates in 2017-18. Not a joke.
Of course, when the court date approached, they’d file for a continuance...and almost always get it as long as they had no criminal arrests while bonded out.
My mother would often find herself at the grocery in line behind well-dressed welfare queens with books of food stamps, buying top tier groceries, and having them carted out to a late model sedan. By 1968, my parents were also dreading that their three sons would soon be draft eligible for the jungles and rice paddies of Vietnam. And two formerly solid Democrats thereby became conservative Republicans and brought their offspring along with them.

I’m sure that was frustrating. Hopefully we never return to that practice. No continuance, and a failure to appear should result in an immediate arrest warrant and deportation order.
Further encouragement to self-deport or NOT come illegally in the first place. Cutting off all the free ‘bennies’ (phones, cash cards, food stamps, free medical care, etc.) and now no freedom to be out & about in the country (and potentially ‘disappearing’ into the citizenry) should shut off a lot of the reasons for coming illegally & turning the country into a third world dumping ground.
