No. Superman SAYS “truth, justice and the American way” during a certain window when the comics industry was under heavy attack and that wanted to get Superman on TV.

He IS a symbol of kindness and friendship. And immigrant success. And also a little bit of Exodus and a bit of Samson. Really he is an allegory of Jewish immigration in the early 20th century.

So, if you want to consider the legal status of this "Strange visitor from another planet"

1. Technically he isn't human, so Kal-El/Superman is no more illegal than a Gecko crossing the border. Clark Kent, obn the other hand, might be guilty of fraud, but if he isn't human, how could he be tried and found guilty?
2. If you want to include him as a rational animal, under the class of human, he could qualify for permanent residency several ways:
a. The Kents could sponsor him after adoption
b. His planet blew up. Sounds like a reasonable qualification for Refugee status.
c. Diversity Visa is good for underrepresented places. He should be fine. The Bottle City of Kandor is in the Arctic, so they are okay.
d. EB visas can also help him:
