“We reject [the 5th Circuit’s] approach as improperly narrowing the requisite Fourth Amendment analysis,” Justice Elena Kagan writes in Barnes v. Felix.”
Bite me Kagan.
The decision was unanimous.
If the account is to be believed, there was zero reason to use deadly force. Many cops are WAY out of line these days. The fact that traffic stops are risky to police officers cannot be an excuse for just letting them shoot people. If you don't want to have a risky job, don't be a cop.
I’ve seen the video. That shooting was 100% proper and necessary!
A process developed after months of deliberation and thousands of pages of studies, interviews and expert’s discussions to a provide guidance to police decisions that will take less than a second in practice. Monday morning quarterbacking is easy.
It’s the hoidy toidy faux intellectual legalese these phonies use that’s so repulsive.
I completely concur. My dad was a cop in the 70s but today’s cops are much more aggressive.
“As the car began moving, Felix “stepped onto the car with his weapon drawn and pointed at Barnes,” “’shoved’ his gun into Barnes’s head, pushing his head hard to the right,” and fired two shots.”
ya, for all kinds of reasons, that’s messed up right there.
I’m surprised there was no mention of Garner v Tennessee 471 U.S. 1.
I’m that opinion, the Court ruled that deadly force was a violation when the fleeing suspect was unarmed and did not present a deadly threat to others.
Courts have allowed and approved the shooting at fleeing suspects for decades. If the flight puts the officer in danger of being hit by the car.
Cops - knowing this - have found it prudent to place themselves at minimal risk which gives them cover to fire away.
1. Suspect reaches for the ignition.
2. Cop leans against the door.
3. Suspect begins to leave and cop backs safely off the door.
4. Shots fired.
ALL THIS HAPPENED IN LESS TIME THAN IT TAKES A USSC JUSTICE TO TAKE TP OFF THE ROLL TO “TAKE CARE OF BUSINESS”
NONE OF THEM HAVE EVER HAD TO MAKE INSTANT DECISIONS.
Most likely Barnes would still be alive if he hadn’t attempted to flee.
Woman killed during D.C. chase was shot five times from behind, autopsy shows
Why? Is deadly force appropriate for possible toll violations?
This is so simple...
Swallow your pride for a couple minutes and do exactly what the cops tell you to do.
99.9% chance you will survive without any injuries.
No outstanding warrants or probable cause?
You will be home, or at work, or at your favorite pub, in less than 30 minutes.
The cop already had his gun out and pointed at the driver before he started to drive off, and when that started, he jumped on the bottom of the door and shot the driver.
Over unpaid tolls, that someone else had racked up on the rental car.
If police are so concerned about safety during a traffic stop, maybe they should make fewer of them by not engaging in road piracy.
Assuming they're not trying to score points with a phony DUI arrest.
That’s a non-sequitur...you must have replied to the wrong post,
Yeah, but he was probably guilty of something.
