Musk's DOGE team can access sensitive data for now, appeals court rules

April 7 (Reuters) - A divided federal appeals court on Monday put on hold an injunction that blocked Elon Musk and his Department of Government Efficiency from accessing Americans' private data at the Treasury and Education departments and the Office of Personnel Management.

In a 2-1 vote, the 4th U.S. Circuit Court of Appeals stayed the March 24 preliminary injunction issued by U.S. District Judge Deborah Boardman in Greenbelt, Maryland, while the government pursues its appeal.

The Richmond, Virginia-based appeals court separately voted 8-7 against taking up the matter "en banc," meaning all active judges would decide.

A dissenting judge warned that letting DOGE access personal information belonging to millions of Americans "lets the proverbial genie out of the bottle."

The appeals court set an expedited schedule for the appeal, and will hear oral arguments on May 5.

Five labor groups led by the American Federation of Teachers and six military veterans accused President Donald Trump's administration of violating federal privacy laws by letting Musk's team review Americans' sensitive personal data.

Obama created United States Digital Service to have access to all federal data systems.

Trump/Musk just repurposed it as United States DOGE Service, and there is nothing you can do about it.

Questions I would ask these Judges.

This personal sensitive information;

WHY does the government have it and where do they keep it?
WHO has access to this information now ?
WHY is a team of auditors assigned by the President of the United States different than a GS-5 working in some obtuse government job entering data off IRS yearly filings ?
How come it takes the average citizen a year to get a lawsuit into court, and it only takes 1 second for these lawsuits concerning DOGE to gather litigants, have them file complaints, have a judge review the complaint, have the judge file a TRO ?

An IRS contracted leaked return data on 405,427 tax payers, including Trump and Elon Musk,to the NY Times and ProPublica.

There is already no security or privacy.

They can’t blame that on Trump, Elon Musk, or even conservatives generally, so they’re sticking with fear-mongering about something that hasn’t happened, rather than something that has but can’t be blamed on their hate parade members.

Looking at my military retirement account happens constantly, as nearly as I can tell. SocSecurity looks, Ohio looks, Fed looks, military looks, medicare looks, pharmacies look... a host of entitities look.

So, pretending that the bureaucracy doesn’t look is a ridiculous assertion. Potus wants to know that a retiree isn’t dead. Seems reasonable to me.

We already know that crimes have been committed, including fraud & waste.

since when is it illegal to hire experts to do a forensic search for evidence ?
