Memphis is suing Tennessee's Shelby County Election Commission over a gun-control referendum that the council wants placed on the Nov. 5 ballot.
The City Council filed the lawsuit Friday morning after the commission said that it would follow direction from state leadership and not place the issues on the ballot.
The ballot questions ask about preventing individuals from carrying a handgun without a permit, banning the sale or possession of “assault rifles” in most cases with some exceptions and the addition of extreme risk protection orders, often referred to as red flag laws.
The ballot initiatives conflict with state law, which allows for permitless carry, monitoring firearm sales and prevents red flag laws.

Memphis has no interest in enforcing any laws right now! What ridiculous point would a gun referendum be for? A felon with a handgun, Glock Switch, and a stolen car, gets zero charges. Nothing. Released on a signature if even arraigned at all. All charges will be dropped by Steve Mulroy.
Actually City Councils can create laws, but those laws may be overturned. In other words, they do not have the final say regarding the laws they create.
Memphis doesn’t have authority to override state law.
But even the Republicans on the city council voted for it.
What would the people at the county club think if they didn’t vote to get rid of those scary rifles?
This looks like a case of the Tail trying to wag the Dog. Too bad they can’t be un-elected.
“Local govt’s who want to be progressive & evade state laws will lose shared sales tax funding,” Sexton wrote. “Subversive attempts to adopt sanctuary cities, allow boys in girl’s sports, limit 2A rights or other attempts will be met with stiff resistance."

Seriously though, can any city or county overrule state laws the majority of their rulers don't like? If we continue down the path of feudal Democrat city-states trying to rule over Republican-dominant counties it can only lead to literal breakdown of law and civilized behavior.
