A Kentucky man who was the first known person to breach the U.S. Capitol on Jan. 6, 2021, has been sentenced to more than four years in prison.
Michael Sparks, 47, was convicted in March by a federal jury in the District of Columbia on all six charges that he faced, including two felony offenses of obstruction of an official proceeding and civil disorder.
On Aug. 27, U.S. District Judge Timothy Kelly sentenced Sparks to 53 months in prison and fined him $2,000.

Every single defendant charged with that is going to have to individually move to dismiss based on the SCOTUS precedent. No way a judge could just sua sponte dismiss in the interests of justice for the same reason. Process is punishment.
It’s like having to fight in court for the matriculation of each black student in an all-white college based on Brown vs. Board, and federalize the national guard in each case, too. This sucks.

If doors were opened by the capitol police, that’s a different defense.
This guy used poor judgement, which shouldn’t get you 4 years.

the only people killed that day was Ashley Babbit (unarmed woman shot in cold blood by security) and some old lady beaten to death by capitol police
one capitol policeman died of a heart attack but the media insisted he was killed by Trumpers...the family tried to set the record straight but the enemedia would not listen
btw a half dozen capitol police “committed suicide” within a few months after Jan 6

Did the police need to warn Ashli Babbitt? In a home breaking are we obliged to warn the intruder force-ably gaining entry to our home? NO WE DO NOT HAVE TO.
Now given that there were about 15-20 armed riot police right behind Ashli Babbitt, and given her actual intentions, there was no cause to shoot her.
But our ‘Stand your ground’ laws for home defense would allow the shot.

“On Thursday, January 7, 2021, a tipster, who will be referred to as T-1, called the FBI’s National Threat Operations Center (NTOC) and identified MICHAEL SPARKS as being the first individual to climb through a broken window into the U.S. Capitol building on January 6, 2021.
The next day, an FBI agent interviewed T-1 by telephone. T-1 explained that (s)he is an acquaintance of SPARKS and overheard SPARKS discuss plans to travel to Washington, D.C. on January 6, 2021 to attend the pro-Trump rally. (S)he heard SPARKS tell another person, “This time we are going to shut it down.” “
