Charges dismissed in controversial Monongah traffic stop that went viral

Marion County Prosecutor Jeffrey Freeman has dropped the charges against Beth Delloma, 45, after a traffic stop Thursday went viral due to the actions of Monongah Police Chief Nathan Lanham.

Delloma was stopped Thursday for an expired registration sticker by Lanham, who was not in a typical uniform or a marked cruiser. The interaction spiraled out of control when Delloma asked for identification and Lanham refused. Lanham pointed his service weapon at Delloma several times and wrestled her to the ground as she attempted to flee the scene for help.

“He filed a motion to dismiss the case,” Delloma’s attorney Joe Shaffer said of the prosecutor during a Monday appearance on MetroNews “Talkline.” “He asserts in the motion that the facts in the complaint do not support the felony charge of fleeing in a motor vehicle and reckless indifference to the safety of others.”

Shaffer said Lanham pulled her over initially wearing khaki pants with a firearm strapped to his thigh and a nylon t-shirt and requested her driver’s license, registration, and proof of insurance. Because of the uniform, she cracked her window and asked Lanham for identification, and he identified himself Monongah police chief and became irate, Shaffer said.

Shaffer said Delloma wanted to escape what she thought was a police impersonator by telling him the documents were at her home and began to drive slowly to her home, which was about 30 yards away.

“We’re talking about a 49-year-old woman who is very intelligent and she’s aware of cases across the country where people have impersonated police officers and pulled over women,” Shaffer said. “The shirt he had on can be purchased on Amazon.”

If you’re lucky, support your sheriff and his force. Local pd, that is highly militarized… no way. These folks have access to APCs.. a posse commitatus work around. Courtesy of the patriot act. The founders would have already shut that down.

Yes, actually there have been many police impersonators that fit that exact description. Do a YouTube search and you can spend the rest of the day watching them. Another thing that impersonators do is refuse to show official ID.

I remember before cameras I’d see a story where the cops said someone “resisted arrest”, “made a furtive move” “reached for his waistband” and the story just seemed fishy. I’d get into arguments with this fellow who was a lawyer who represented police, and he’d get very angry that I’d question these stories.

When cameras became more common, many of these “fishy” stories did, in fact, turn out to be police frauds.

There is no right to flee or to resist arrest.

Resisting arrest is always endangering the cop and violating the cop’s civil right to a safe work place.

Cops neede batons and billy clubs to adequately contain criminals who resist

I noticed you got attacked here.
I have cops on both sides of the family.
They are all pricks.
In and out of uniform.
Former friends who joined.
They had Napoleonic syndrome before they joined.
Now its out of control.
I will not trust any of them.
They are all trained to lie.

In 1994 I had a friend raped and murdered by a man with a fake badge, a fake police light bar on his car and unfortunately, a real gun.

Yeah, and you can also find dozens of stories of seemingly innocuous drivers, even females, shoot at police officers if they let their guard down. He asked for her drivers license. Just hand the cop your drivers license and if you have a concern, dial 911 while he’s running your information. By the way, this did not happen on a country road out in the middle of nowhere. This was in a neighborhood.

I guess the shirt that had the word “police” on it, the blue lights on the unmarked car, and the black handgun screamed police impersonation! The cop may have overreacted, but this idiot driver is at fault, too

That is unfortunate. So your point, I guess, is that every American is free to drive away from a police stop because of the one in 10 million chance the cop is an impersonator? By the way, we are assuming that her version of events is the accurate version of events. But all of these stories always exclude information that is exculpatory towards the police officer. In the one video, I hear the woman shout “I know my rights.” That doesn’t sound like a concern that the officer is an impersonator.

I suspect that the prosecutor figured that the officer was too rough with her during the arrest and just decided to let the case go. I have no issue with the decision to drop the case. But I do take issue with these obstinate people who think they can just disregard the lawful orders of police officers.

There are several cases like that of police impersonators rapists despite that they usually get severe sentences. One of the first was in California in 1948, Caryl Chessman represented himself, was convicted of kidnapping, sentenced to death, and executed after a then record 12 years.

Since the Chief was NOT in uniform and flat out REFUSED to properly identify himself, he should be Criminally Charged with Impersonating a Peace Officer and Thrown in PRISON until he learns to respect the citizens he works for.

Straw man arguments are not appreciated nor welcome. The alleged cop was not wearing a uniform, was in an unmarked car, and refused to produce ID, which is far from the “what you’re saying is” statement.

As a very peaceable citizen with an ultra-clean record ...

The police are a greater threat to me than are common criminals.

If a common criminal threatens me or assaults me, I can defend myself with lethal force if necessary. If such defense results in the common criminal's death, most normal Americans will support my actions.

If a police officer threatens me or assaults me, I cannot defend myself AT ALL without being damned to hell as a "cop-killer".
