House Speaker Mike Johnson said Sunday he could foresee “legal hurdles” in some states if President Biden is replaced as the Democratic nominee.
He told CNN’s Jake Tapper on “State of the Union” that Democrats will have “real problems” if Mr. Biden is pushed to be replaced.
“I mean, every state has their own election system. That’s our constitutional system,” said Mr. Johnson, Louisiana Republican. “That’s the way it’s done. And in some of these states, it’s a real hurdle. They have a real problem of replacing the nominee on the top of the ticket.”

Ballot access isn't the issue. Any legal challenges will be predicated on state laws that govern the administration of primary elections.
Basically ... What exactly is the purpose of spending taxpayer funds to administer a primary election if a political party can simply drop a candidate who wins the primary?

I like it—the remedy would be for the states to sue the Democratic Party to recover the cost of funds used for the primaries.
Memo to the speaker: Biden is not the nominee. There is no need to replace anyone.

The Democrats don’t have a nominee yet to “replace” so this doesn’t apply. No delegates have voted yet on naming a nominee - Biden was not yet the nominee to be “replaced.”
Biden is not the nominee yet, as he hasn't been voted on by his delegates in the nominating convention yet.
That said, I did post this thought yesterday:
the states may certainly weigh in on the Democrats' plans if they made the states conduct sham primary elections, only to ignore those results at the last minute because their candidate is losing badly in the polls.If the Democrats pull a fast one here, I'd like to see some states sue the Democrat National Committee for the cost of holding the Democrat primary in their state if the results of that election are subsequently ignored for political opportunism.

Wisconsin, for example, stipulates Biden must die to be replaced. The state is doubly crucial for Ds, which explains why they pulled Biden before he was officially on that ballot.

As the Dems haven’t had their convention yet how can anyone be officially top of their ticket yet?
This really leads to a larger question, specifically why do taxpayers fund primaries? The reality is that the two parties control the elections and that’s one way they get access to government funds to pay for party activities. It’s wrong, but can’t be stopped. As part of that, I seriously doubt primary elections are binding in any legal sense. We’ll see, maybe.
I agree completely. They pulled him before he was on the ballot. So what is the Speaker talking about?
