Article III, Section 1 established lifetime tenure for Supreme Court Justices. The Dems cannot set term limits via legislation. That would have to be by Constitutional Amendment.

The executive can appoint judges/justices. But they have no more control over them than they do the Congress. And Congress has no control over the Supreme Court either.

Term limits and the number would need to be codified on the Constitution.

If Congress has a bone to pic with them, they can impeach.

President Biden is finalizing plans to endorse major changes to the Supreme Court in the coming weeks, including proposals for legislation to establish term limits for the justices and an enforceable ethics code, according to two people briefed on the plans.

Not to be argumentative, but tenure or “terms” are not addressed in the Constitution. I think the writers never imagined that people in government would want to stay into their dotage.

That said, we would need to change the constitution to address this, as the “right” to regulate the SCOTUS is not defined.

The Supreme Court can declare the changes to be unconstitutional. I doubt if a Constitutional amendment goes anywhere.

I expect that Biden might try to do it with an Executive Order.

What is he going to issue another one of his illegal executive orders?

He is not king although he might think that he is especially since congress sits on their rears and lets him issue them without restriction.

I think that he and the dems are unhappy because the system (the judicial branch) is checking their attempt at unrestricted unlimited power.

Those only effect the Executive Branch and would have exactly zero effect on SCOTUS.

This will go nowhere.
It’s the sore-loser syndrome.
The US has lived with far left, liberal SCOTUS decisions for decades and nobody proposed changes to the Court simply because we lost.
This Court now actually reflects the will of the American people, and the left can’t take it.
The left’s reactions have always been childish when they don’t get their way, and never more so than with SCOTUS.
Their desperation is palpable.

That's a measure of desperation commensurate with a Soviet leader on his way out attempting to pack the Comintern -- just as Andropov attemtped to prevent Gorby, and yeah the Comintern is not a SCOTUS, but the Soviets don't have a court system that resembles anything like justice *spit* shove that up your tailpipe, Putlims -- but stolen elections have real consequences.

And don't for a moment overlook the real-life comparisons between Bidendropov and Andropov. Years of not just prosecuting the opposition but actually persecuting the opposition. The scumbags behind Andropov had finally seized the levers of the State away from the Brezhnev cadre, and when he fell ill, his State bolsheviks refused to release them, while attempting to murder both Chernenko and Gorbachev. They succeeded with Chernenko.

The framers set the separation of powers very specifically so that one branch does not gain authority over the other. the only powers Congress has over the individual judges is approval or removal. That's it. Congress establishes the structure of the court, so they can add judges as needed. But as far as creating term limits or a code of ethics would have to be an amendment to the Constitution. Good luck with that.

I think one of the more interesting things about this renewed effort to change the court, they are not talking about adding four new Supreme Court justices. This might be a hint that they don't believe they will be naming or confirming judges for the next few years. Those decisions are going to be made by Republicans for a while.
