The unidentified father logged into The Children's Courtyard's livestream on July 27, 2023 and watched in horror as a daycare worker smothered his son in an attempt to keep him quiet during nap time, a new Texas lawsuit claims, according to KVUE.
The employee then allegedly pulled the covers off and repeatedly slapped the child in the face and head when he did not sleep.
The father then rushed to the facility in Austin to confront staff members about what he had seen, but the daycare never reported the abuse to state officials or law enforcement, according to the suit.
Officials at the daycare also allegedly told the worried parents the employee in question would be suspended for one day for their actions.
The child's mother, Alexis Dominguez, is now seeking $1million in damages for her son's physical and emotional injuries.
She claims in the lawsuit that the video showed her son trying to cover his face and head with his hands to block the hits from the unidentified care worker.
But the repeated slaps caused the boy to 'rock back and forth with each blow,' the lawsuit claims, according to the Idaho Statesman.
Dominguez and the child's father ultimately decided to take their son out of the daycare, and reported the incident to state authorities themselves.
'Clearly The Children's Courtyard did not value my son's safety or express concern for his well-being,' she said.
'Anyone with basic common sense understands that smothering and hitting a child is completely unacceptable.'
The Texas Health and Human Services Commission Child-Care Licensing Division and the Texas Department of Family and Protective Services investigated the incident, and cited the daycare for five violations.

Parents need to raise their own kids. Hubby and I did it. I had my own medical transcription service and worked from home and between us we figured out a way to make it work. I’ll admit they went to preschool but only part time for a year or two, but leaving your kids for 12 hours a day with ppl watching them for minimum wage just made no sense to us.

That daycare person needs some serious time in jail, and the facility should be drained dry on their insurance coverage and any assets.

What a stupid comment. Are you really that mean spirited? I would think the parents relied on the center’s clean record and reviews by other parents.
It is not the mom’s fault that a child care worker was abusive. As far as she knew the workers there were qualified and her child was safe.
Not every mom can afford to stay home.

Analyses done by accountants that I have seen show that the extra income brought in by the second income are minimal after taking out daycare, convenience food, extra gas and mileage on the cars, and the extra expense of buying good work clothes.
I stayed home with my kids and did my own domestic chores, had the opportunity to shop sales, and do home cooking.
We could not afford a lot of extras, but I got to see my own kid's milestones myself and we spent a lot of time together and did a lot of fun and educational activities.
They're adults now and those years are gone forever, but I do have the memories and lots of pictures.

There is no reason to be that unnecessarily rough with them.
Either take care of your own children or don’t have them. There is no other way. None. There is no other acceptable choice. That includes people with profitable careers. Your children will only be little once. They are your responsibility and yours to nurture and love. Yours alone.
My first job was daycare. If I saw this happening, I would have either snatched that kid from that woman or grabbed her hair and pulled her back so hard I’d give her whiplash. Then I’d call police.
You know this woman has abused other children. I’m sure she’s bitter that she can’t have kids and in some desperate attempt to feel motherly took the job, then began to resent that too.
Some women shouldn’t be near children.
