New York v. Trump: Merchan delays sentencing hearing until September

Judge Juan Merchan has delayed former President Trump's sentencing in New York v. Trump to September, after requests from the presumptive Republican nominee to do so, and no opposition from Manhattan District Attorney Alvin Bragg. Trump was found guilty in an unprecedented criminal trial last month on all counts of falsifying business records in the first degree, following a six-week trial stemming from Bragg's investigation. Trump on Monday moved to overturn his criminal conviction in the Manhattan case after the U.S. Supreme Court ruled that a former president has substantial immunity for official acts committed while in office. He also requested to delay his sentencing, which was set for July 11 — just days before the Republican National Convention where he is set to be formally nominated the 2024 GOP presidential nominee. Bragg, on Tuesday morning, said Trump's request to toss the verdict was without merit, but did not oppose the request to delay sentencing. Merchan on Tuesday afternoon delayed Trump's sentencing date to Sept. 18.

He knows the verdict now has to be a mistrial. The evidence of his statements about Cohen while President are inadmissible.

Merchan delayed his sentencing to September to coincide with the September 10th Trump/Biden debate.

Merchan will give Trump probation and then promptly hop on plane for an extended vacation.

People will hardly notice, because all anybody will be talking about is Joe coming down with another cold...what are the chances?...... Poor guy has some bad luck😀

I think your line of reasoning has merit. If Trump stays so popular and Biden continues to cling to dementia politics Merchan is probably reading the writing on the wall and looking to get out of his self inflicted Babylon dilemma.

"If such is necessary, or other proceedings". That's a lot more than just removing the date. I think the clincher is the future FEDERAL crime Trump was supposedly conspiring to skirt.....that turned the clerical entries into a Felony.

Motive was one of the things that SCOTUS mentioned.

And I believe ALL the entries were after he was President.

Trump, as of now, is in the drivers seat about any debate. Biden, right now, needs one, Trump does not. Ill debate if I have no gag order and no sentencing over my head...

Seriously, the law compels him to declare a mistrial based on the SCOTUS decision. If he just does a sentence anyway, Trump can appeal this immediately back to the highest court.

Merchan knows the gig is up.

Not a mistrial...I think that means it can be tried again. He has to dismiss with prejudice...which means it can NEVER be tried again.

Of course this wetback’s final decision will be “nothing to see here...the defendant is sentenced to a year and a day at Riker’s Island.” And that will be *after* people are back to their regular lives (meaning they’re paying attention) and meaning it will be announced *days* before voting begins in many states.

I've heard that there's a way for DJT to skip the state courts. Don't know if it's true or not...although given the recent SCOTUS ruling it just might be.
