BBC: Case against Trump 'may fall apart'

Two lines from the opinion, where the Supreme Court justices address the trial judge in Trump's election interference case, are getting a lot of attention

"And the parties and the District Court must ensure that sufficient allegations support the indictment’s charges without such conduct," they write.

That means that once the official acts are stripped away, the trial court must decide if there's enough still in the indictment to go forward. They're basically warning that the case against Trump may fall apart.

They also write: "Testimony or private records of the President or his advisers probing such conduct may not be admitted as evidence at trial."

Private records typically include texts, emails and notes, which means a lot of what Trump wrote on 6 January, 2021 may not be used as evidence

Plus Justice Thomas Clarence in a separate supporting opinion questioned whether this special prosecutor office was even legal.

Look at you, A couple of months ago you were cheering the persecution on, now you have to lament the case is falling apart. I must admit, I am rather enjoying that.

liberals are too stupid to realise this helps their side also!

Now Trump wont be able to prosecute Obama for instance for weaponizing the justice department against conservative groups. Since the motives behind official acts can’t be considered now.

They are panicking....they missed. They know they are likely toast. They must be hoping they get prosecuted under an official federal (leftist) system and not a citizens arrest.

As an 8th grader I was required to take a US government class, where I read the Constitution for first time. I was introduced to the concept of checks and balances, to prevent any government overreach. We were also required to pass a citenship test, to receive a passing grade. Those were the days.
