They said Biden’s performance in the first presidential debate against former President Donald Trump raised questions about his ability to perform his office.

Prosecution is already off the table as Hur said he’s not fit to stand trial. Last night this was confirmed. Worse, he’s not fit to be in the White House now. We cannot let him remain for seven more months. Sure, that gives us Harris, but is that really worse than Biden at this point? And this is all separate from November 5th.

The 25th Amendment has nothing to do with presidential immunity or the lack thereof. If you are thinking of a diminished capacity defense, that is not the same as immunity and is an affirmative defense. That means it would be up to Biden to prove at any trial that he did not have the mental ability to form the required criminal intent at the time of the crime. It would not be up to the prosecution to prove the opposite
It also puts Harris on the ticket as it is unlikely the party could avoid her as she'd be the sitting president.
And the house could sit on approving a VP, so Speaker Johnson would be next in line.
