SCOTUS Opinion day [Friday, June 28, 2024]

The Supreme Court will be issuing opinions on cases from the October 2023 term at 10:00 a.m.

You can read the opinions released thus far at Supreme Court opinions.

There are eight cases remaining on the document.

October sitting: All opinions have been released;

November sitting: All opinions have been released;

December sitting: All opinions have been released;

January sitting: Two cases remain. These are the two Chevron deference cases. Relentless and Loper Bright. I suspect the Opinions in those cases will be released as one.

February sitting: There are three cases pending.

Corner Post v. Board of Governors of the Federal Reserve System, (an Administrative Procedure Act issue), and the two First Amendment cases. Moody v. NetChoice, LLC, and NetChoice, LLC v. Paxton.

March sitting: All opinions have been released.

And then there are the cases we are all waiting for from the

April sitting: There are three cases remaining. The Trump immunity case and the Fischer vs. U.S. case involving Jan 6 defendants and the obstruction charged brought against many.

And, City of Grants Pass, Oregon v. Johnson, (Whether the enforcement of generally applicable laws regulating camping on public property constitutes “cruel and unusual punishment” prohibited by the Eighth Amendment.).

The Justices issue Opinions in order of reverse seniority. (Example, if the first Opinion announced is written by Kavanaugh, that means we will not hear from Jackson or Barrett today.) The reverse order is Jackson, Barrett, Kavanaugh, Gorsuch, Sotomayor, Kagan, Alito, Thomas, Roberts.

Scotusblog is reporting that this is NOT the last day for Opinions as in previous years. I can only recall one time that the court did not finish up by the end of June. Of course, we do not live in “usual or normal” times.

An interesting observation by Amy: Typos -- 6 opinions issued this week, and 4 of them already have corrections! Including "nitrous" oxide (laughing gas) changed to nitrogen oxides... What's going on behind the scenes?

I never knew that they corrected opinions. How common is this?

Yes, in 2020 they went over. They started out the blog that this would be the last day, not suggesting it won’t be. Something like what 9 decisions pending?

It’s actually pretty common in all Courts to have modified opinions to correct typos etc.

I pray that they will rule, and RIGHTLY on TRUMPS case today. It would be a added victory for him after lasts night debate!

We have the first opinion — Grants Pass v. Johnson. It is by Justice Gorsuch, and the vote is 6-3 with Sotomayor dissenting, joined by Jackson and Kagan.

The Ninth Circuit is reversed and the decision is remanded.

The court holds that the enforcement of generally applicable laws regulating camping on public property does not constitute “cruel and unusual punishment” barred by the Eighth Amendment.
