Washington man allegedly kills teen because he mistook an airsoft gun for a real firearm

The King County, Washington, Prosecuting Attorney's Office has charged a man with second-degree murder and assault, both felony counts, for allegedly shooting a teen he thought was holding a gun and who he believed was about to rob a sporting goods store.

Aaron Brown Myers, 51, told police he believed the 17-year-old victim had a gun and was going to rob a Big 5 Sporting Goods store in the Seattle suburb of Renton last Wednesday as the teen headed toward the retailer with two others, according to court documents filed by the prosecutor, Leesa Manion.

The boy was holding an airsoft gun, according to a police affidavit. An airsoft gun is a replica firearm that shoots low-power, nonmetallic pellets.

The two teens who were with the victim told police they were going to the sporting goods store to either return or exchange the airsoft gun because it was malfunctioning, the affidavit said.

What I don’t see is whether the “toy” airsoft gun had the required orange tip on the barrel which is intended to prevent tragic situations like this.

Was the orange tip removed or colored black to make a toy look more realistic and possibly deadly?

If so, why was this done? Was it just a kid’s macho fantasy, or was it something more sinister?

It doesn't make much sense to question what somebody tells you, when they tell you that is what they believed. What you are really doing is calling that person a liar. So, is that what you are doing? He is on record as saying that is what he believed. So, if you don't think he believed that, what evidence do you have to the contrary? That would take the ability to read his mind. I don't know of anyone who has that power.

It depends upon the circumstances under which they gave their statement. If they made a statement that they would later have to prove, I would tend to put a lot of credibility in that statement. It was his statement that he believed a holdup was eminent, and he appears to be stacking to it. Under weight of law, he may have to back up that statement, and he appears to be doing it. On the other hand, if you have the magic ability to read peoples' minds, then a fortune is out there for you.

There was no cop involved in this incident. It almost sounds like the kid, if he had had a real gun, would have been justified in shooting the man.
