Still...it’s gotta be done. His lawyers need to take whatever action is necessary to move the appeal up to the USSC.
Yes the New York appeals court is hopelessly corrupted and will present a delay that will create irrevocable harm to the accused.
And any action on the part of the USSC will not be politically biased...just legally fair.
So what’s your solution?

With our system of division of powers, it is clear the Ajudicatory Power has become corrupted by this Lawfare practice and the SC since its early days has guarded the power to police its own limits. It will not want the Legislative branch to attempt a remedy. The Chief Justice is very much an activist on this power and will side with members wishing to take an active role IMHO.
The question remains unanswered: by what mechanism could the SC intervene?
The SC needs to get off its ass. This is why they exist.
Who cares? It’s not like they’ll be ok with the Supremes if he said nothing. And they have made it clear they intend to remake and expand the court if they get both houses and the White House.
So it’s an act of protecting the Supreme Court itself for them to take this case. If they fail to stop this outrageous national judicial tyranny that affects the entire nation, they have no purpose remaining.
