His lawyers did not do a good job. And what worries me, as an appellate lawyer, is that they didn't do a good job preserving the record for appeal. They focused exclusively on the trial, which is what many trial lawyers erroneously do," Dershowitz said. "But you can't win an appeal if the lawyers below didn't create a record for appeal. And they didn't do that here, particularly the missing witness, the issue of, the failure to allow the expert witness to testify."

I think he’s right. I saw a lawyer Blanche on FOX with Jesse and I was disgusted. I’m sure he made a ton while letting his client get railroaded.
I have to wonder if none of the really good lawyers will risk their careers by defending Trump.

Clarence Darrow, one of the greatest American attorneys of the 20th century, wouldn’t have been able to get Trump off. That is how bad this trial was rigged.
The biggest issue they neglected to preserve was the fact that Allen Weisselberg was not called.
Fact is , the judge offered the Trump team an opportunity to compel him to testify.
The risk is that the prosecution would give him a Cohen style deal to lie in exchange for freedom which would have been a disaster for Trump. Deeshowitz is focused on picking apart this case. Trump's team has to consider multi front, multi jurisdiction litigation in DC, in Florida and in the SCOUTUS - all the while considering the politics of running for President.
It's complicated and Trump is doing a really good job of threading the needle. Besides - how much more does Trump need to overturn this kangaroo court verdict on appeal.
Merchan knows Trump will win the appeal. He just wants the optics of a convicted felon presidential candidate for the election because he knows the appeals won’t overturn anything before Nov 5th.
Merchan will be a very rich man, one way or the other.
I’m surprised that Greta, who once was a highly regarded criminal defense attorney before she became a TV star during the OJ Simpson trial, didn’t ask Dershowitz exactly how in New York state courts defense counsel “preserve the record” on adverse decisions by the judge in a criminal trial. Have his attorneys properly made their 5th, 6th and 14th amendment arguments? If not, can they do so now by moving for a mistrial or for a judgment of acquittal notwithstanding the verdict filing a written motion and a memo of points and authorities?
It's a pretty good chance that Trump's defense team has been in constant collaboration with a team of appellate lawyers throughout this case.
No lawyer could overcome Judge Engoron’s antics.

Dershowitz has represented many unpopular clients. To criticize him for that is wrong. It's like attacking the messenger. It's what he does, and it does it very well.
I am hoping he takes Trumps case for the appeals. If he doesn't Trump will have to pick a lawyer from the few lawyers who are willing to jeopardize their life and the lives of their families. The opposition isn't fooling around.

Why didn’t Dershowitz say DURING the trial they weren’t preserving evidence for appeal?
