I’m speaking of SCOTUS rulings that stated the specific crime had to be agreed to in unanimity by the Jury.

In other words, Juror #1 can’t think he’s guilty of Manslaughter and Juror #5 think he’s guilty of murder - for a murder conviction.

Judge Merchan told the jury they don’t have to agree unanimously on what the Crime is Trump committed.

It’s a very big deal.

Modern judges have complete contempt for jurors who will nullify their faulty instructions on the "law". I've never seen any case law supporting swapping out jurors who "refuse to deliberate" from before the Bill of Rights was ratified.

It’s been proved 57 times, the law is what Merchan says it is.

He’s going to get his man, and being overturned down the road doesn’t hurt the Dems.

The can do a lot of strong arming. They keep them in deliberations, he can sequester them. He can change the foreman. He can tell them to get back in there and work it out.

He’s not letting them have the Jury Instructions because he wants to discern their direction and herd them to a guilty position.

I’m reading that as the Defendant must consent to the choice of the alternate juror as to whether or not they are acceptable. I am not reading it as the Defendant has any input as to the juror being disqualified by the judge.

I used the same analogy as well. You can’t just list a bunch a crimes and say as long as everyone agrees at least one of these occurred the defendant is guilty.

Each crime must be a unanimous verdict.

Either way, if the defendant refuses to agree, it’s a mistrial.

What if the defendant won’t agree that any of the alternates are acceptable? Bearing in mind that Merchan approved as jurors/alternates people who had said that they hate Trump.

The words “I don’t think they can...” with regard to what the regime can and cannot do, are no longer applicable.

We don’t yet realize how far it’s gone but we’re going to find out.

That would be the whole point of alternate jurors.”

In New York Supreme Court the alternates sit in the jury box for the whole case. Once the deliberations begin they are dismissed.

Exactly. If the judge can’t be 100% transparent and truthful in providing clear, concise instructions I can reference and read about a specific crime and the relevant evidence it’s a “not guilty” 110% of the time.
