Why Alvin Bragg’s ‘Jackson Pollock’ prosecution is more likely to produce a hung jury

Abstract artist Jackson Pollock once said that his paintings have no objective meaning, so the best way for people to enjoy them is to stop looking for it. For many of us, Manhattan District Attorney Alvin Bragg has created a new school of abstract law where there is no need for objective meaning. The jury is simply supposed to enjoy it for what it is: a chance to convict Donald Trump. Pollock was famous for his painting drips on large canvases. Bragg has achieved the same effect by regenerating a dead misdemeanor on falsifying business records as 34 felony counts. To achieve that extraordinary goal, he has alleged that the document violations (which expired long ago under the statute of limitations) were committed to hide some other crime. .... As it stands, there are three crimes that have been referenced by prosecutors: state and federal election violations and taxation violations. Bragg’s legal vision for non-objective indictments was greatly advanced by Judge Juan Merchan, who will allow the jury to reach different rulings on what crime is actually evident in Bragg’s paint splatters. Merchan has even ruled that the jurors can disagree on what actually occurred in terms of the second crime. This means there could be three groups of four jurors, with one believing that there was a conspiracy to conceal a state election violation, another believing there was a federal election violation (which Bragg cannot enforce), and a third believing there was a tax violation, respectively. Nonetheless, Merchan will treat that as a unanimous verdict. In other words, they could look at the indictment and see vastly different shapes, but still send Trump to prison on their interpretations.

Another attempt to describe Merchan's nonsense. Turley: However, the only thing worse in New York than being a Trump supporter is being a chump. To rely solely on Cohen and not even call someone like Weisselberg is to play these jurors as chumps.

I’m going to go out on a limb and run against the current. I think ONE juror at least will not vote to convict thus the ridiculous farce will END with a HUNG JURY.

The Bronx rally directly refutes that ALL of NYC hates Trump.

I read that Merchan plans to instruct the jury that they can imagine any predicate crime that they want to imagine to find guilt. Just make something up.

I wish this judge would at least have enough integrity to just say the jurors, “listen you need to find Trump guilty” because I’m biased as a lefty

Can't agree on this. The only way it would end in a hung jury is if Orthodox Jews had been allowed on the jury. But the judge,knowing this,declared Friday a "business" day thus meaning that they would refuse to serve.

It's possible that the jury won't issue verdicts on every count but I'd bet the clothes on my back that they'll vote guilty on a good number of the more important charges.

He's one of those cock-eyed optimists who has complete faith in the integrity and honesty of every man and woman who serves on a jury in this country.

Atticus Finch had that same faith...and we saw what it did for Tom Robinson.

I don’t believe people like Turley can fathom the level of corruption of the judicial system in NY, although some in the media and elsewhere are beginning to grasp what’s going on. Others may be starting to understand that this could be one of those “sauce for goose” moments.

Not sure the evil side is confident in their strategy. Are they hoping for a conviction, then riots? Sounds plausible and likely. J6 however has not worked in their favor and neither did George Floyd provide a win. They desperately need a win. But here is also a thought. Could the evil side want to strengthen a politically weak Biden by having him appear in his White House speech on the verdict as magnanimous in telling the people the justice system which found trump innocent, worked? none of their lawfare has worked in the way it was designed and only made Trump stronger. So this theory Also sounds plausible. Convoluted but plausible.

I believe this jury will convict. No riots. Win on appeal. And Trump will grow even stronger. The evil side will allow Trump to slaughter Biden in Nov. They will then go underground and regroup for 28.

I’ve long felt that conviction was a certainty as is a win in appeal. However, after the farce of a presentation by the persecution team and knowing that two of the jurors are lawyers, it now seems that Turley is right: hung jury.

I don’t think the jury will hang. I believe every last one of them were ready to pronounce him guilty before they ever sat down. I hope I’m wrong.
