So far today he’s already rejected an email from Cohens former attorney that rejects Cohens entire testimony and won’t allow Trump’s team to submit a document proving where Trump was during Cohens alleged call to him about Stormy Daniels.

The email from Cohen's former attorney is hearsay. The document proving where Trump was would come in after the prosecution rests its case, when Trump's team has the opportunity to present evidence. Trump's team could also call Cohen's former attorney who could then authenticate the email or simply testify to the contents.

Actually, one point that’s gotten a lot of discussion in the media is whether Trump will testify in his own defense. It’s clear that he’s allowed to. Speculation is that he wants to but that his attorneys are urging him not to testify.

In the first trial against E. Jean Carroll (civil case for defamation and sexual assault), Trump took his attorney’s advice and didn’t testify. He lost. Since then he’s been saying (correctly IMO) that he got bad legal advice in that instance. So maybe he’ll overrule his lawyers and take the stand this week.

Will the court hold an evidentiary hearing on the matter of this theft? And if not, why not (beyond the obvious political aspect)?

It’s not “LIKE” that. It’s EXACTLY that, and they are blatant about saying so. He’s been told he can’t defend himself, can’t say he’s innocent, etc.

In TX, the same thing happened to Alex Jones. Whether you like him or not, in America defendants have a right to ... DEFEND ... themselves. That’s why they’re called defendants.

They have First Amendment rights. Until they don’t.&

I don’t see a problem here. The State of New York need only retroactively change the law so that it’s no longer theft under $1000 but Theft under $61000 dollars that is not criminal. This is why we want strong progressive DAs after all.

Where do you get that? He has an absolute right to take the stand and defend himself and say he’s innocent. (The gag order doesn’t apply to in-court testimony). Whether or not he testifies, his attorneys can defend him in other ways.

Most notably, because the prosecution has the burden of proof, defense attorneys can sometimes win without putting in any evidence, just by cross-examining the prosecution witnesses — which Trump’s attorneys have done. They can also put in evidence instead of or in addition to Trump’s testimony.

The Grand Jury doesn’t have to see exculpatory evidence. However, the defense must receive ALL of it.

Can he be arrested for stealing?
I read that the democrats knew about the theft and covered it up. Can they be arrested as accessories?

They wanted Cohen to lie about Trump and put him in jail. They did not count on the Trump lawyers getting him to confess to grand theft stealing.

Trump has hired thousands of people. It would be great if they were all good people, but life is not like that.

I am a huge believer in ‘projection’. People tend to think other people are just like them. Good people think everyone else is good, liars think everyone else is lying.

I believe Trump is good. That’s how he has survived this endless assault. There’s nothing to find.

Hiring Cohen to do one of the many thousands of things he has on his plate was a mistake, cleatly, but hindsight is always 20-20
