Kyle Tate is charged with grand theft and criminal mischief...
A Palm Bay, Florida Homeowners Association board member was arrested last month after allegedly pulling a gun on three kids fishing at a lake in his subdivision, taking their equipment and throwing the rods, reels and tackle into the woods..
Police charged 57-year-old Kyle Patrick Tate with criminal mischief and grand theft as a result of the incident.
A court affidavit filed in Brevard County, Florida alleges that on April 14, officers with the Palm Bay Police Department were dispatched to a suspicious incident at Stillwater Lakes, a subdivision owned and managed by an HOA.
FOX 35 in Orlando confirmed Tate is the president of the community’s HOA.

The responding officers spoke with three kids who were fishing on the south side of the lake in Stillwater Lakes, who said a man, later identified as Tate, walked up to them while holding a firearm and telling them to get off his property.
But the property belonged to the HOA, not Tate, according to police.
Still, Tate grabbed their fishing rods, reels, tackle boxes and other equipment, before throwing the equipment into the woods and damaging them.

The kids told police they estimated the fishing rods and reels to be valued at $1,900; the tackle boxes and lures inside to be valued at $150; and cast nets to be valued at $150.
Tate also allegedly took a phone valued at around $1,500 from one of the kids, which has not yet been recovered,

Young death is always sad, and people shake their heads for multiple years over the why and what if. Compounding an unfortunate and tragic accident by making somebody completely innocent of the situation lose everything is wrong. Especially in cases of trespass.
And what was the source of the disagreement, a person fishing in a neighborhood which led to a discussion about HOAs and property rights and rules of a neighborhood, the guy was an idiot for pulling a gun but the other question was his decision to stop a person from fishing

Did you miss the part of where, if he’s a due paying owner in that neighborhood, he is part of the HOA.
One thing we don’t know for sure is if he neighborhood HOA has rule against fishing, which in Florida they likely do, I used my Florida Neighborhood as an example, we have signs in the community lake prohibiting fishing perhaps you missed that as well, not just myself, but everyone in the neighborhood has the right to tell someone fishing to stop, if for no other reason than liability issues.
As I’ve stated the gun part was stupid and likely criminal. You can’t seem to separate legitimate property rights issues and HOA rules from the fact the guy was an idiot.
And that means zip zero. Did you miss the part where this mental case was hauled off to jail and charged with multiple felonies? ☺
Being a dues paying owner in a HOA absolutely gives you the right to tell people to stop what they are doing if they are violating the rules. The owners are the HOA, if you are an owner you are part of that.

And that's not what happened anyway, is it? You keep bringing up something that never happened. This guy threated young kids with a gun and now he's charged with multiple felonies. His HOA rights have zip zero to do with this story.
