I am in the courtroom and will be reporting on the continued testimony of Stephanie Clifford, aka Stormy Daniel, against the lead candidate for President of the United States, Donald J. Trump.

The District Attorney’s Office has entered the courtroom, sans Alvin Bragg.

President Donald J. Trump and the defense has re-entered the courtroom. Emil Bove walked in with him along with Eric Trump, Alina Habba, Boris Ephstyn and Natalie Harp.

Merchan has reentered the court

Todd Blanche starts the proceedings asking for a MISTRIAL, saying the guardrails have been completely removed with regards to the testimony.

Blanche continues, the alleged incident in 2006 is so far outside the realm of the case, has nothing to do with the case, is extraordinarily prejudicial, and the only reason the prosecution asked the questions is to smear the defendant, Donald J. Trump, in the eyes of the jury.

Blanche continues: Stormy Daniels has inserted safety concerns in a case about business records.

This is the best I’ve seen Blanche so far during the trial, he came out with conviction and clarity.

Blanche continues: I think you (the Judge) knew there could be prejudicial testimony, hence you put the guardrails. That is not what we heard today from Stormy Daniels, the prosecution has completely gone off the rails, and there is no remedy for the defense, Donald J. Trump.

Blanche continues: We believe regrettably there should be a mistrial and to the extent there is another trial, this witness should be excluded or limited.

DA’s side up: This story is directly related to the $ paid from Donald J. Trump to Stormy Daniels.

Todd Blanche up again to continue Defense’ objection to Stormy Daniels: This is extraordinary testimony that is prejudicial to the jury that has absolutely nothing to do with the case or the charged conduct against Donald J. Trump.

Judge Merchan ruling now…

Judge Merchan: as a threshold matter there were probably things that would have been left unsaid, the unfitness was a little out of control. Having said that, i do think there were guardrails in place. I don’t think we’re at the place where this trial (inaudiable).

I will note that there was not more objections (my side note: of course, if Trump team objects too much, it can look toxic to the jury).

I believe the remedy is on cross-examination. I will rule on this:

Necheles makes the objection point that I did in the previous tweet. Merchan says we will have to agree to disagree.

I don’t believe we have reached a point where a mistrial is warranted.

I do think it was regrettable some of the things that were said by the witness and I will point out that the more times Stormy Daniel’s story has changed, the more opportunity you have in cross examiniation

So I am going to deny your (President Donald J. Trump’s) request for a mistrial.

Stormy Daniel’s attorney has reentered the courtroom, Judge Merchan asked if she had the opportunity to speak to the witness; she said yes.

The jury has reentered the courtroom and the prosecution will continue to question their witness, Stormy Daniels.

Prosecution (ADA): Asking Stormy Daniels about an email from Keith Davidson to Michael Cohen. Daniels voice is cracking and slurring her words, as pointed out by @PaulIngrassia earlier today.

Judge Merchan has sustained two of President Trump’s defense teams objections to the ADA’s questioning of Stormy Daniels. It seems to little to late though as it is about the January 10, 2018 letter, not the salacious details that the jury heard about before lunch.

ADA: What was your life after the Jan 12, 2018 WSJ Article?

Stormy: My life got turned upside down.

ADA: Did you get paid when the WSJ article came out?

Stormy Daniels: No

(My question: is that why she changed her story because she was pissed that she did not get paid for ‘the reveal’?)

Stormy Daniels: Talking about January 30, 2018 statement Stormy Daniels signed. She says she signed this statement different from any other way she’s ever signed Stormy Daniels (her stage name) as a tip off to Jimmy Kimmel the statement was false.
ADA: Michael Cohen was making public statements that upset you?

SD: Because he was making public statements about this and I could not.

Susan Necheles (Trump D): Asking about Mock examinations the ADA’s office ran her through.

Necheles keeps hitting on the “pretend’ examinations the ADA put Stormy Daniels through.

Trump D: Am I correct that you hate President Trump?

SD: I want him to be held accountable.

Trump D: Pointing out that you just laughed at Stormy Daniels’ tweet saying she would dance on the streets if Trump went to jail.

Trump Defense Attorney hitting on the fact that Stormy Daniels lost a defamation case against President Donald Trump in the past and had to pay over $500,000 dollars.

My note: CNN, who had been typing ferociously during the Prosecutions’ questioning, has slowed noticeably since the Necheles has started cross examining the witness.

Trump D points out that number that Stormy Daniels is actually supposed to pay is $560,000, plus 10% annual interest, per the state of California.

Trump D: You haven’t taken one penny out of your pocket to pay President Trump, is that correct?

Stormy Daniels: Yes.

Trump D: You are ignoring a court order not because you don’t have money. You have announced publicly that you will NEVER pay President Trump any money

Stormy Daniels: That’s correct

Trump D: Did you tweet: “I will go to jail before I pay a penny.”

Susan Necheles: I did.

Trump D: Even though there are three court orders to pay President Trump, you will not pay, is that correct?

Stormy Daniels: I don’t know.

Stormy Daniels tweet: “I don’t owe him shit and I’ll never give that orange turd a dime.”

Trump D: Do you recall giving an interview to Jeff Tobin where you said you will not fill out that debtor form?

Stormy Daniels: Yes

Trump Defense: Isn’t it true that your daughter’s name was only asked for once to identify you.

SD: I don’t know, my attorney filled out that form.

Interesting that she knew a question ago but doesn’t know now.

Attorney’s, again sans Todd Blanche, who is conversing quietly but intently with President Trump, approach the bench.

Necheles is doing a fantastic job showing the Stormy Daniels is willfully ignoring a court order to pay Donald Trump. I expect Necheles will begin to show the inconsistencies in Stormy’s testimony.
