The precedent is Democrat Vice-Presidents who have no legal right to keep "classified" documents shall not be charged for illegally keeping them, while Republican Presidents who have the ultimate authority over what is "classified" and what is not shall be prosecuted for classified documents legally in their possession.
Think of the ramifications of the precedent in this case on the various cases against Trump.
