BREAKING: Judge Rules Fani Willis Can Continue Trump Prosecution—But There's a Catch

Fulton County, Ga., Superior Court Judge Scott McAfee made his decision on whether District Attorney Fani Willis can continue prosecuting Donald Trump and 18 other co-defendants on corruption charges.

McAfee ruled that Willis can continue to prosecute the former president and his co-defendants, but he has given the state multiple options to handle the case. All options involve Nathan Wade stepping away from the team.

“The prosecution of this case cannot proceed until the State selects one of two options,” McAfee wrote in his decision. “The District Attorney may choose to step aside, along with the whole of her office, and refer the prosecution to the Prosecuting Attorneys’ Council for reassignment... Alternatively, (Special Assistant District Attorney) Wade can withdraw, allowing the District Attorney, the Defendants, and the public to move forward without his presence or remuneration distracting from and potentially compromising the merits of this case.”

Willis campaigned as an anti-corruption candidate in 2020 because accusations of sexual and financial wrongdoing surrounded her predecessor, Paul Howard. She declared to an interviewer that the people of Fulton County “deserve a DA that won't have sex with his employees [and] won't put money in their own pocket.”

McAfee ordered a hearing into Willis’ conflicts of interest after reports surfaced in January that Willis was allegedly carrying on an affair with Nathan Wade, an attorney she hired as a special counsel on the case. Despite his lack of experience with RICO cases, Willis paid him more than more experienced attorneys for his work.

Willis also allegedly dispatched Wade to meet with Biden administration officials about the Trump prosecution.

1. The defense counsel doesn't give a damn about any testimony from Wade that is related to the proceedings of the case and the operations of the prosecution. They want him as a witness so he must identify the names of the people he met in Washington and the nature of their conversations. You then subpoena THOSE people as witnesses in the case.

2. There should be an underlying presumption here that attorney-client privilege would not apply in the dealings with the Washington players because: (A) this is a state case, not a Federal case; and (B) the people in Washington of greatest interest to the defense are not DOJ types, but political office holders and their staff members (White House personnel, J6 committee members, etc.).

3. Having a disqualified prosecutor on the case plead the 5th would be the best thing that ever happened to Trump and his co-defendants. This would be grounds for an immediate dismissal of the charges, since the defendant in a criminal case cannot have his Sixth Amendment right to call witnesses in his defense abrogated by a witness' Fifth Amendment rights against self-incrimination.

I will start by saying the ruling should have been for her, and her office to be taken off the case, and another DA takes the case if he wants it.

That said, the good news is, here’s where we are now:

1. Although she is still the prosecutor, Fani’s case has been set back weeks (months?).
2. She is still being investigated by the House (misusing grant money), Ga. Senate and local county commission for misusing her funds.
3. She looks preposterous trying a case for Trump’s “conflict of interest”
4. Based on the stuff discovered in the last few weeks, there is probably more to be found, which may shut down the case again.
5. Regardless of the outcome of a trial, the opportunity for an appeal is off the charts.

Yes. We’ve all learned that black women in particular can not be held accountable for their actions because they are “not perfect.” Black men are lower on the leftard hierarchy so Willis can dump Wade with ease (she’s probably tired of him by now anyway) keep her job and retire to some “university” and get a plum professor gig.

Good post. I think there is too much focus here on the "disqualification" side of the story. The disqualification question was always of secondary importance to the underlying facts of the case. Disqualifying a prosecutor, in and of itself, doesn't make a criminal case go away. It just means the case must be tried by a different prosecutor.

If anything, a defendant in this case would much rather have it prosecuted by a politically motivated ghetto slob like Fani Mugabe than a real prosecutor whose reputation isn't already in shambles.

Why are there so many bullshit corrupt justice department officials and judges when it comes to Trump and why do they keep getting away it. Why do we let them? Nobody follows the rule of law anymore, so why have laws? In the end this leads to complete lawlessness and collapse of society as a whole.

Great points, but I still wouldn’t assume the law on what should be privileged and what should not, including whether Wade will even be allowed to testify, will be followed by this judge. That’s if he’s truly on the side of Willis, which is the knee jerk reaction to this ruling

However, I think he’s half hoping Trump will appeal, he’ll approve it, and they will be the ones to lower the ax on the whole trial. You can sort of sense that, by how he is leaving it up to Willis to decide if she will recuse herself, or ask Wade to, instead of just making a decision of any kind on his own.

Then he could try to wipe his of any repercussions of that, whatever they may be. But leaving the decision up to someone who appears to have already lied under oath before the court is equivalent to calling out for an appeal himself. He has to know, even if Wade is removed and Willis stays on, it will be a circus, with her being called before Congress, having the bar potentially sanction her, etc. So this could be his way of trying to end it, without actually doing it himself. At least I’m hoping so.

As we have learned, neither of these two was competent to try this case. I don’t think anyone in Fat Fani’s office can either. So nothing has really changed. This case was a grift from the get go. I’m not sure how Biden/Obama fix that and not get caught meddling.

This proves there’s no negative consequence for multiple, biased and corrupt Dem officers of the court conspiring to lie, then lying multiple times to a corrupt court.

I can’t imagine Fanni having any difficulty making this trivial choice.
